AWARDING BID FOR
2014 ROAD IMPROVEMENT PROGRAM PROJECT
PHASE 2 -A
WHEREAS, the Borough has publicly advertised for the receipt of bids for the 2014
Road Improvement Program Project, Phase 2 -A; and
WHEREAS, the Borough has solicited and received five (5) bid proposals for the 2014
Road Improvement Program Project, Phase 2 -A as follows:
Total Base Bids
I. S. Brothers General Contractors
$ 2,181,037.50
2. Lucas Brothers, Inc.
$ 2,459,542.00
3. P &A Construction
$ 2,492,825.25
4. Black Rock Enterprises
$ 2,519,492.45
5. Top Line Construction
$ 2,825,052.95
WHEREAS, S. Brothers General Contractors has submitted the lowest bid for said
contract as evidenced by the response on file with the Borough's Purchasing Department
and with the Borough Engineer; and
WHEREAS, the Borough Engineer has reviewed the above bid proposals and has
recommended the award of a contract to S. Brothers, in a total amount not to exceed
$2,181,037.50; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be available
for said purpose.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough
of Carteret as follows:
I. That the appropriate Borough officials are hereby authorized to enter
into a contract with S. Brothers General Contractors, South River, NJ
for the 2014 Road Improvement Program Project, Phase 2 -A in the
amount of $2,181,037.50¢1 accordance with all respects with the
request for proposals and bid on same.
2. That a copy of this Resolution shall be forwarded to the Borough's
Purchasing Department and Borough Engineer.
Adopted this 10"' day of April, 2014
and certified as a true copy of the
original on April 11, 2014.

Dear Mayor and Borough Council:
Enclosed herewith please find a summary of bids received on April 8, 2014, for the above
referenced project. .A total of five (5) bids were submitted, ranging from an apparent low
base bid of $2,181,037.50 by S. Brothers, Inc., to a high base bid of $2,825,052.95 by Top
Line Construction. The Engineer's Estimate for the base bid was $2,228,400,00. Please
find enclosed a complete Summary of Bids for the Council's review.
It should be noted that there were several irregularities present in the bids submitted
including that of the apparent low bidder, S. Brothers Inc. whose package did not include a
subcontractor experience sheet. We believe that this irregularity is minor in nature and not a
mandatory cause for rejection; therefore, the outcome of the bid is unaffected.
As a matter of procedure, our office has contacted S. Brothers, Inc. to discuss their bid, The
representative we spoke to indicated they are comfortable with the bid as submitted and
there is no objection to completing the project based on the bid prices submitted and the
contract time.

Based on this information, we recommend the following actions:
Award of the contract to the low bidder, S. Brothers, Inc., PO Box 317, South River, NJ
08882 within 60 calendar days, on a unit price basis in the total amount of $2,181,037.50
for bid Items 1 through 44 as available funding permits. The award should be subject to
review and approval by the Borough Attorney, including concurrence to waive the minor
irregularities, the review of the bid bond and surety from the low bidder, and submission
of the required bonds and Insurance certificates for the project.
2. Bids and bid securities of the second and third low bidder, Lucas Brothers, Inc. and P &A
Construction, be retained and held open, pending execution of the contract agreement
by S. Brothers, Inc.
By copy of this letter, we are requesting the Borough Attorney prepare the necessary
Resolution of Award. Upon execution, please have four (4) signed and sealed copies of the
resolution forwarded to my office for further execution.
