BAL HARBOUR VILLAGE COUNCIL MEETING MINUTES
ATTORNEY/CLIENT SESSION - MAY 19, 2009
An Attorney/Client Session of Bal Harbour Village was held on Tuesday, May 19, 2009, in
the Bal Harbour Village Council Chambers (655 — 96th Street, Bal Harbour, Florida).
1. CALL TO ORDER/ROLL CALL: The meeting was called to order at
8:00 a.m. by Mayor Rosenfield. The following were present:

Assistant Mayor Joni D. Blachar
Councilwoman Patricia Cohen
Councilman Martin Packer
Councilman Jaime M. Sanz
Alfred J. Treppeda, Village Manager
Ellisa L. Horvath, CMC, Village Clerk
Andrea Greenblatt, Administrative Assistant
Richard J. Weiss, Village Attorney
Michael S. Popok, Village Attorney
Mary G. Stephenson, Taylor Reese and Associates, Inc.
2. PUBLIC MEETING OPENED: As a quorum was determined to be
present, the meeting commenced.
3. STATEMENT BY MAYOR: Mayor Rosenfield announced the time to be
8:00 a.m. She explained that the Council will have an Attorney/Client Session, in
accordance with Florida Statute 286.011, regarding the litigation styled Lynne Bloch -Mullen
versus Joel Jacobi, Bal Harbour Village, and the Miami -Dade Canvassing Board, Dade
County Circuit Court Case Number 07-12570 CA 08. She advised that the session is
estimated to last one hour and the following people will be in attendance at the meeting:

Councilwoman Patricia Cohen
Councilman Martin Packer
Councilman Jaime M. Sanz
Village Manager Alfred J. Treppeda
Village Attorney Richard J. Weiss
Village Attorney Michael S. Popok
Mayor Rosenfield advised that the proceedings will be recorded by a certified court reporter
(Mary G. Stephenson, Taylor Reese and Associates, Inc.) and that, at the conclusion of all
litigation discussed, the transcript will be made part of the public record.
Mayor Rosenfield welcomed any public comments.
4. PUBLIC MEETING CLOSED: There being no comments, Mayor

Rosenfield closed the meeting to public comments. All individuals not named by Mayor
Rosenfield left the room.
5. EXECUTIVE SESSION - LYNNE BLOCH-MULLEN V. JOEL
JACOBI, BAL HARBOUR VILLAGE, AND THE MIAMI-DADE COUNTY
CANVASSING BOARD (CASE NO. 07-12570 CA 08): The Attorney -Client
session was held.
6. PUBLIC MEETING RECONVENED: The meeting was reconvened in
public session at 9:05 a.m. Mayor Rosenfield explained that the Attorney/Client Session
was terminated and that members of the general public were invited back into the meeting
for any further proceedings or matters. Those present were:

Mr. Weiss requested another Executive Session for the case, to be scheduled by the Clerk. It
was the consensus of the Council to do so.
7. ADJOURN: There being no further business to come before the Council, the
meeting was adjourned at 9:05 a.m.
