HomeMy Public PortalAboutResolution 89-1508 PC" " RESOLUTION NO. 89- 1508PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DENYING ZONE VARIANCE 89 -1003, A REQUEST BY CHARLES & GEORGIA BROWN SHELBURNE TO ALLOW A SECOND STORY ADDITION WITH A SIX (6) FOOT SIX (6) INCH SIDE YARD SETBACK INSTEAD OF THE REQUIRED TEN (10) FOOT SIDE YARD SETBACK FOR A SINGLE FAMILY RESIDENCE IN THE R -1 ZONE FOR PROPERTY LOCATED AT 10558 DAINES DRIVE. The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing for the above Zone Variance, the Planning Commission finds: 1. That there are no exceptional and extraordinary circum- stances or conditions applicable to the property which do not generally apply to other properties in the same zone in that the site is 72 feet by 180 feet, where a proposed second story addition could be constructed and meet minimum code requirements; and 2. That such variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated but which is denied to the property in question in that other similarly zoned properties throughout the City are developed with two story additions which have been constructed in accordance with the Zoning Code requirements in effect at the time of construction; and 3. That the granting of the variance will be materially detrimental to the public welfare or injurious to adja- cent property in that the proposed addition would be situated closer to the side property line than permitted by current zoning criteria which would result in a loss of privacy for adjacent property owners; and 4. That there are no special circumstances as provided in Section 65906 of the California Government Code in that the subject lot is rectangular in shape and generally level in grade and does not possess any unique features relative to size, shape, or topography.
