BE IT ORDATNED BY THE COW'TON COUNCIL OF TN-E CITY OF RICHMOT-M, INDIANA: SECTION 1. That Chaoter 42 of the Municipal Code of Richmond, Indiana, be, and the same is hereby amended to read as follows: CHAPTER. 42 PARKING METERS 42.01 DEFINITIONS. Terms used. in this chaoter shall have the meanings set forth in Chanter 41 of the Municipal Code of Richmond, Indiana, and as follows: Municipal parking facility: Any soace off a public thoroughfare, which is municioally owned and operated or leased for the puroose of providing and regulating narking of vehicles, including any legally designated area easily accessible from a oublic thoroughfare either at ground level or multi6le levels or floors above or below ground including equipment, end-rances, exits, fences, and all other accessories necessary or desirable for safety and convenience in the off-street parking of vehicles. Ooerator:- Every individual who shall overate a vehicle as the owner thereof or as the agent, employee or oermittee of the owner. 42.02 OFF STREET PARKING FACILITIES. (a) There is hereby established and fixed certain real estate to be known as municipal oarking facilities in the City of Richmond, described as follows, to -wit: 1. Lot No. 116 and a Dart of Lots No. 28 and 29 of the Original Plat of the City of Richmond, Indiana, laid out by John Smith, more particularly described, as follows: Beginning at the nointcf intersection of the easterly line of South 5th Street with the Soi;th line of South A Street, as now constructed; thence east; albng the south line of said South A Street 129 feet to a oublic alley, 10 feet in width; thence southward ly along the west line of said alley 8h.12 feet; thence west, na.rallel with the south line of South A Street, 129 feet to easterly line of 5th Street; then north- wardly, along the easterly line of South 5th Street 84.12 feet to place of beginning. 2. Lot No. 169.in Charles Starr's Addition to the City of Richmond, Indiana. 3. The north half of Lot Pdo. 18 in Jeremiah Cox's Addition to the City of Richmond, Indiana. 4. Part of. Lot No. 168 in C. 14. Starr's Addition to the City of Rich-ond, Indiana, beginning 74 feet..north of the southwest corner of Lot No. 167; thence north along said alley to the southeast corner of Lot No. 169; thence :-lest along the south line of Lot No. 169, 180 feet to Tenth Street; thence south to the olace-of beginning. 5. Lots Nos. 14 and 15 in that oart of the City of Richmond laid out by Jonathan Mattis, and also Lot No. 13 in that oart of the City of Richmond laid out by Jonathan Mattis, exceoting a strip 6 feet bride off of the south side of said lot, and Lots Nos. 67 and 68 in Bickle and La,•rs Addition to the City of Richmond. 6. Lots Nos. 13 and 18 in Jeremiah Cox's Addition to the City of Richmond, Indiana. 7. Lots Nos. h4 and 45 and the north half of Lot No. 46 in Jeremiah Cos Is Addition to the City of Richmond, Indiana, and 53 feet off of the north side of Lot 63 in C.W. Starr's Addition to the City of Richmond, Indiana. (b) ; In any of the 'municioal narking facilities" or any parts or Dortions of separately designated municipal off-street parking facilities, the Board of ?u.blic _-Iorks and Fafety may cause narking meters to be ;nstalled at each space in such municipal off- street Darking facilities, in its discretion, available for parking of vehicle or vehicles, and shall see that there shall be olainly indicated on each of such meters the tme limitatign for -parking. The time limit for parking and the charge to be made for the use of each narking space, and the money to be placed in the meter in each particular parking space by the person using such parking soace shall be plainly marked on each meter and shall be as follows: (a) In spaces for which a gold meter is Placed: Time limit: Two Hours Charge: Two hours - one ten cent coin of the United States. One hour - one five cent coin of the United States. (b) In spaces for which a blue meter is placed: Time limit: Five Hours Charge: Five hours - two ten cent coins of the United States olu.s one five cent coin of the United States. Two hours - one ten cent coin of the United States. One Hour - one five cent coin of the United States. (c) In spaces for which a green -meter is placed: Time limit: Ten Hours Charge: Ten hours - two twenty-five cent coins of the United States. Five hours - one twenty five cent coin of the United States. Two hours - one ten coin of the United States, One hour,- one five cent coin -of the United States. 42.04 INSTALLATION OF T,`ETERS. The Board of public 11orks and Safety is hereby directed to provide for the installation, regulation, control, operation, use and. maintenance of -parking meters and the Board of ?ublic Works and Safety is hereby vested -vrith -cower and authority to enter into a contract after an.-oroval of the terms and con- ditions thereof by the Mayor, for the purchase and/or installation of parking meters. The Board of ��'ublic Works and Safety is authorized and. empowered to enter into a contract or contracts after a ,-oroval of the terms and conditions thereof by the Mayor, for such protection and maintenance of the parking meters as may be necessary to maintain the same in good operating condition and to pa;7 for --such oasts, protection and maintenance, ex- clusively, from the receipts, funds and revenue received from the operation of said park- ing meters. 42.05 PLACING OF METERS. Parking meters installed in the off-street parking facilities shall be placed immediately adjacent to the individual parking places. Each parking meter shall be placed or set in such manner as to show or display by a signal that the narking space adjacent to such meter is or is not legally in use. Each parking meter installed shall indicate by orooer legend the legal parking time established by the city, and when operated shall indicate by some appropriate device the duration of the period of legal narking, and on the exoiration of such period shall indicate illegal overtime narking. 42.06 PARKING SPACES. The Board of Public Works and Safety shall have lines or markings nai.nted or placed upon the of" -street parking facilities adjacent to each parking meter for the puroose of designating the parking space for which the meter is to be used and each vehicle parked adjacent or next to any narking meter shall nark within the lines or markings so established. No Person shall park a vehicle across any,such line or mark- ing or park a vehicle in such position that the same shall not be entirely within the area designated by such lines or markings. 42.07 DEPOSIT OF COINS: OVERT12iE PARKING. 'When a vehicle is parked in any space adjacent to which a parking meter is located, the operator of the vehicle shall, uoon entering the parking soace, immediately deposit or cause to be, deposited a coin of the United States in such oarking meter. Upon deposit of such coin and placing the meter in operation, the narkin;�soace may be lawf ully occupied by the vehicle during the period of Parking ti-e which has been prescrioed for the area in which the narking space is located. If the vehicle .remains parked in any narking space beyond the parking time limit � . - i • - tt. , _ r� ill •��, _. �,1 ., _ _ � (, :' - -. - - for such parking soace, the parking meter shall by its dial and pointer indicate such illegal narking and in that event, the vehicle shall be considered as narked overtire and beyond the period of legal barking time, and the oarking of such a vehicle over- time or beyond the neri od of legal parking time in any such pa rking s-oace shall be in violation of this chanter. 42.08 HOURS OF OpERATTON. No person shall cause, allow, -permit or suffer any vehicle registered in the name of, or operated by such person to be narked overtime, or bevond the neriod of legal ,oarking time established for any municioal off street parking facility at any time between the hours of 8:30 o'clock A.M. and 5:00 o'clock P.M. on Tuesday, Wednesday, Thursday and Saturday, and between the hours of 8:30 o'clock A.M. an-- 9:00 o'clock P.M. on I�Tonday and Friday, Sundays and legal holidays excepted. 42.09 PARKING NEAR EX"I_RED r TER. No oerson shall oermit a vehicle to remain in any pa.rkine space adjacent to any parking meter while the meter is displaying a signal indicating that the vehicle occupying such narking space has already been narked beyond the period of time prescribed for such oarking space. 42.10 EXTENDING !TETER TIME. No person shall deoosit or cause to be deposited in a parking meter an ad,litional coin for the ouroose of extending the parking time beyond the maximum time fixed for lawful parking. 42.11 UFE OF SLUGS. No person shall deposit or cause to be deoosited in any park- ing, meter any slug, device or metallic substitute, or any other substitute for a coin of the United States. 42.12 DAMAGTNG PETERS. No person shall deface, injure, tamper with, open or wif- fully break, destroy, or impair the usefulness of any parkina meter installed under this chaste r. 42.13 TICKETING VIOLATIONS. (a) It shall be the duty of the police officers of the city to reoort: 1. The number of each narking meter which indicated that the vehicle occupying the parking soace adjacent to such narking meter is or has been parked in violation of this chapter. 2. The statb license numne r of such vehicle. 3. The length of time during which such vehicle is m.rked in violation of this chanter. 4. Any other facts, a knowledge of which is necessary to a thorough understanding of the circumstances attending such violation. (b) Each such police officer shall also attach to s ,ich vehicle a notice to the owner or operator thereof that such vehicle'has been oarked in violation of this chapter and instructing such owner or operator to -report at the office of the City Controller in regard to such violation. Such owner or operator may, within 48 hours of the t_me when such notice was attached to such vehicle., nay to the City Controller.as a penalty for and in full satisfaction of such violation, the sum of One Dollar ($1.00). Provided however, that if the fine for said violation shall be paid on the same date and day of the violation thereof, the fine for said violation shall only be fifty cents (500) instead of One Dollar (�1.00). The failure of such owner or ooerator to make such .payment within 48 hours shall render such owner or ooerator subject to the penalties provided for iiolation of this chapter. h2.14, PARKIAiG METER FUND. The coins required to be deposited in narking meters as rrovided herein, when collected from such parkin; meter, shall be deposited with the City Treasurer, to thecredit of the City of Richmond, Indiana, in a soecial fund from which disbursements shall be made only under the orders of the Board of Public Yorks and Safety and disbursements shall be made for no other o urposes-than: (a) Payment of the purchase price, rental fees and cost of installation of parking meters; (b) Dayment.of the cost of maintenance, operation, reoair and all other incidental costs and exoenses in the operation of the ;parking meters, includinw the cost of clerk and bookkeeping; (c) Payment of the cost of traffic signal devices used in theC!ty of Richmond, Indiana; WOO. .. - "2, .i .+ .r'S•• ,.','; q0 vinjej NNS WNq S xC, r_t n f < i,` - S{; t �i_; ! ,Ay, i a 'T .
