A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF TEMPLE CITY APPROVING MODIFICATION OF
CONDITIONAL USE PERMIT 77 -511, A REQUEST BY SHELL
OIL COMPANY TO REMODEL AN EXISTING SERVICE STA-
TION /CONVENIENCE STORE AT 5450 NORTH ROSEMEAD
BOULEVARD (9010 BROADWAY)
The Planning Commission of Temple City does hereby re-
solve:
Section 1. Based upon a public hearing for a Conditional
Use Permit to allow the remodel of an existing gas station at
5450 North Rosemead Boulevard (9010 Broadway), the Planning
Commission finds:
1. That the site for the proposed use is adequate in size,
shape, topography and circumstances in that the site is a
corner lot with an approximate land area of 21,026 square
feet with a 154 feet of frontage on Rosemead Boulevard, a
state highway; and 129 feet of frontage on Broadway, a
collector road; and
2. That the site has sufficient access to streets and high-
ways, adequate in width and pavement type to carry the
quantity and quality of traffic generated by the proposed
use in that the design and location of the existing is-
lands and proposed convenience store extension allows
traffic entering the site from the north to freely exit in
one direction via a one -way alley which returns to Rose-
mead Boulevard south of the site; and
3. That the proposed use will not have an adverse effect upon
the use, enjoyment or valuation of adjacent property or
upon the public welfare in that the proposed remodel will
improve on -site circulation, and provide additional park-
ing and landscaping thereby having a beneficial effect
upon surrounding properties and general traffic circula-
tion.
Section 2. This project should not result in any signifi-
cant effect upon the environment and a Negative Declaration has
been prepared in accordance with the State CEQA Guidelines.
Section 3. Accordingly, the Modification of Conditional
Use Permit is approved subject to the following conditions:
1. That the proposed development is in substantial compliance
with the submitted development plans date stamped August
22, 1989 except as modified herein.

2. The two existing lots comprising the development site
(i.e, Lot 1 and Lot 2 of Block A of Tract 11218) shall be
combined into a single parcel. This may be accomplished
by recordation of a convenant, deed restriction or other
legal instrument, approved as to form by the City Attor-
ney.
3. That all conditions of approval contained within the
Modification of Conditional Use Permit 77 -511 contained in
resolution no. 88- 1447PC shall remain in full force and
effect.
Section 4. The Secretary shall certify to the adoption of
this Resolution.
I hereby certify that the foregoing Resolution was duly
adopted by the Planning Commission of the City of Temple City
on the 12th day of September, 1989, by the following vote:
AYES: Commissioners Griffiths, Muto, Seibert
