HomeMy Public PortalAbout2425-1969 - Amending Ordinance No. 2231-1966 - Housing Code OrdinanceORDINANCE NO. 2425 - 1969 AN ORDINANCE AMENDING ORDINANCE NO. 2231-1966, COMMONLY KNOWN AS THE HOUSING CODE ORDINANCE OF THE CITY OF RICHMOND, INDIANA APPROVED NOVEMBER 21, 1966. BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. WHEREAS, the Housing Code Ordinance of the City of Richmond, Ind- iana was adopted for the purpose of establishing and enforcing minimum housing standards within the community; and WHEREAS, since the date of adoption of the Housing Code Ordinance, certain sections contained therein have become obsolete and below nationally established standards regarding dwelling unit conditions; and WHEREAS, it is now the desire of the City of Richmond, Indiana to update the Housing Code Ordinance in accordance with these nation- ally recognized standards. NOW THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 2. That the Housing Code Ordinance of the City of Richmond, Indiana, be and the same is hereby amended to read as follows: SECTION 44-4 SANITARY FACILITIES (g) Every dwelling unit shall have a continuous supply of hot water through water heating facilities which are properly installed and maintained in a safe and good working condition; such hot water facilities shall be cap-, able of heating water of such a temperature as to permit an adequate amount of water to be drawn at every required sink, lavatory basin, bath- tub, or shower at a temperature of not less than 1200 Fahrenheit. SECTION 44-5 HEATING FACILITIES (a) Every dwelling and dwelling unit shall be supplied heating facilities which bear the seal of approval of an approved, nationally recognized test- ing agency and which heating facilities are used in the manner for which they are designed and approved. Such heating facilities shall be installed in compliance with the ordinances of the City pertaining thereto and the provisions of this chapter and shall be capable of safely and adequately heating all habitable rooms, bathrooms and toilet rooms or compartments contained therein to a temperature of at least 700 Fahrenheit when the outside temperature is minus 100 Fahrenheit. Doors, windows and other parts of the dwelling or dwelling unit shall be constructed and maintained so as to prevent abnormal heat losses. SECTION 44-6 LIGHTING, VENTILATION AND ELECTRICAL REQUIREMENTS (c) Subsection'(c) to be deleted. ORDINANCE NO.' 1969 Page 2. (d) Every habitable room shall have at least one window which can be easily opened, or shall have an approved ventilation system which is capable of changing the air within same at least four (4) times per hour and which is kept in good working order at all times. The total openable window area shall be equal to at least five percent of the floor area of such room provided such room has no exterior door or shall be equal to at least two per cent -of the floor area where such room has an exterior door. The foregoing ventilation requirement shall not apply where such room is sup- plied with some other approved ventilation system. SECTION 44-8 MINIMUM SPACE, USE AND LOCATION REQUIREMENTS (a) Every room used for sleeping purposes by one (1) occupant, shall have a minimum gross floor area of at least seventy (70) square feet. Every room used for sleeping purposes by more than one (1) person shall have a minimum gross floor area of fifty (50) square feet per occupant thereof. (b) Every dwelling unit shall contain a minimum gross floor area (in addition to the requirements set forth in Subsection (a) above of at least 150 square feet for the first occupant and at least 100 additional square feet of floor space for every additional occupant thereof; the floor space to be calculated on the basis of total habitable room area. (d) The minimum clear floor -to -ceiling heights in all habitable rooms shall be: (1) Basements: Seven feet (7'0") clear under joists. (2) Main floor of living units: Seven feet (7'0"). (3) Above main floor of living units: Seven feet (7'0") clear; under sloping roofs, seven feet (7'0") for not less than 50 per cent of the floor having five (5) feet or more headroom. (e) No cellq'r space shall be used as a habitable room or dwelling unit. (f) No basement space shall be used as a habitable room or dwelling unit unless: (1) The clear floor -to -ceiling height is at least seven (71 . of?). SECTION 44-10 ROOMING HOUSES (c) Roominghouse Facilities (10) Every room in any roominghouse rented for sleeping purposes for one person shall contain at least seventy (70) square feet of floor space, exclusive of hall and closet space; for two (2) persons shall contain -at least one -hundred (100) square feet of floor space, exclusive of hall and closet space, and for each additional person at least fifty (50) additional square feet of floor space, exclusive of hall and closet space, shall be provided. SECTION 3.. This Ordinance shall be in full force and effect from and after its passage, approval by the Mayor and publication as by law required.
