AUTHORIZING AN AGREEMENT WITH THE MIDDLESEX COUNTY
UTILITIES AUTHORITY FOR THE DELIVERY OF CERTAIN MATERIAL TO
THE MIDDLESEX COUNTY LANDFILL
WHEREAS, the Borough of Carteret (the `Borough ") is undertaking a Marina Project
which will entail the removal of certain dredge spoils material (the "Material ") from the
cove adjacent to the Borough's Waterfront Park;
WHEREAS, the Middlesex County Utilities Authority ( "MCUA ") owns and operates a
state of the art landfill facility located in East Brunswick, Middlesex County, New Jersey
commonly known as the Middlesex County Landfill (the "Landfill "); and
WHEREAS, as part of the Marina Project, the Borough will be processing the Material
into a form useable for operations at the Landfill; and
WHEREAS, Carteret desires to deliver the processed Material to the Landfill and the
MCUA is willing to accept up to 30,000 cubic yards of the Material for use at the
Landfill; and
WHEREAS, the Borough and the MCUA (the "Parties ") have negotiated a proposed
agreement for the acceptance and use of Material at the Landfill in accordance with the
terms and conditions set forth in the Parties' Agreement (the "Agreement ") with regard
thereto, a copy of which is attached hereto and made a part hereof.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Borough Cormcil as
follows:
That the above referenced Agreement between the Borough and
MCUA for the delivery of certain dredge Material to the Landfill is
hereby approved in substantially the form annexed hereto.
2. That the appropriate Borough Official(s) are hereby authorized to
execute the Agreement in a form acceptable to the Borough Attorney.
3. That the Borough Attorney is authorized and directed to forward a
copy of this Resolution and the Agreement executed by the Borough to
the MCUA for execution by the MCUA.
