HomeMy Public PortalAbout20130415-1CurrentCouncil 1 REGULAR COUNCIL MEETING, APRIL 15 2013 – FIRST MEETING CURRENT COUNCIL CALL TO ORDER The Regular Council Meeting of April 15, 2013, was convened at 6:00 P.M. by Mayor Eric Struemph. ROLL CALL The following Council Members were present for the roll call: Present: Bray, Carroll, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Absent: None A quorum was declared present. MISCELLANEOUS AGENDA ITEMS Proclamation – Fair Housing Month Proclamation for National Public Safety Telecommunications Week – Captain Bob Cynova was present and introduced Jefferson City Police Department Telecommunications Officers who work in the 9-1-1 center. Proclamation for Host Lion’s Club Sight Week – Several members of the Lion’s Club were present to be recognized and congratulated for their contribution to the community. Proclamation for Arbor Day – Parks and Recreation Director Bill Lockwood was present to accept the proclamation, and commented on some of the accomplishments during the past year to improve and maintain the City’s forestry system. South Elementary School Essay Contest Winners – Councilman Schulte and Former Councilman Rich Koon introduced winners Misses Scarlett Wickham and Siera Richardson, first and second place winners, respectively, came forward to sit in Mayor Struemph’s chair to read their winning essays. Following their presentations, Mayor Struemph congratulated each student. 2 REGULAR COUNCIL MEETING, APRIL 15 2013 – FIRST MEETING CURRENT COUNCIL Recognizing Winners of Board of Realtors Fair Housing Poster Contest – Mr. Hank Vogt from the Jefferson City Board of Realtors, recognized winners of this year’s contest and displayed their winning entries in an overhead visual presentation. Mayor Struemph presented each winner with a City Coin and congratulated them. Recognition of Tree City USA – Angela Belden, MDC Resource Forester, presented the City with a flag designating the City as a “Tree City USA” and congratulated the City on this accomplishment. Presentation by CVB for Capital City Classic Corvette Event – Mr. Chris Wilson made a presentation regarding this event to be held in the City on May 3 and 4 and distributed flyers to the Council. PUBLIC HEARINGS a. Rezoning 0.9 Acres at 3117 Moreau View Drive From C-1 Neighborhood Commercial to RS-2 Single Family Residential, Associated Comprehensive Plan Amendment: Planning and Protective Services Director Janice McMillan gave a staff presentation with background of the proposed rezoning. Following her presentation, the following persons came forward to speak on the issue: In Favor: Mr. Mike Bates, Central Missouri Professional Services, made brief comments regarding this proposed rezoning on behalf of the property owner, and offered to answer any questions. As no one else came forward to speak on the issue, Mayor Struemph declared the evidentiary portion of the public hearing concluded, and announced that the Council will now take up the associated pending bill. 2012-160 , sponsored by Councilman Mihalevich, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE CITY OF JEFFERSON, BY REZONING 0.90 ACRES FROM C-1 NEIGHBORHOOD COMMERCIAL TO RS-2 SINGLE FAMILY RESIDENTIAL, FOR LAND ADDRESSED AS 3117 MOREAU VIEW DRIVE, DESCRIBED AS PART OF THE NORTHEAST QUARTER OF THE 3 REGULAR COUNCIL MEETING, APRIL 15 2013 – FIRST MEETING CURRENT COUNCIL SOUTHEAST QUARTER OF SECTION 22, TOWNSHIP 44 NORTH, RANGE 11 WEST, JEFFERSON CITY, COLE COUNTY, MISSOURI. Bill 2012-160 was read third time by title, placed on final passage and passed by the Ordinance 15104: following roll-call vote as Aye: Bray, Carroll, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None b. As no one else came forward to speak on the issue, Mayor Struemph declared the evidentiary portion of the public hearing concluded, and announced that the Council will now take up the associated pending bill. 2012-161 , sponsored by Councilman Mihalevich, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, REPEALING THE SPECIAL EXCEPTION USE PERMIT GRANTED BY ORDINANCE NO. 13904, AND APPROVING A NEW SPECIAL EXCEPTION USE PERMIT FOR OPEN LAND, FOR PROPERTY ADDRESSED AS 2301 GREEN MEADOW DRIVE, DESCRIBED AS RESERVE TRACT A, RIVERS EDGE ESTATES SUBDIVISION, JEFFERSON CITY, COLE COUNTY, MISSOURI. Bill 2012-161 was read third time by title, placed on final passage and passed by the Ordinance 15105: following roll-call vote as Aye: Bray, Carroll, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None 4 REGULAR COUNCIL MEETING, APRIL 15 2013 – FIRST MEETING CURRENT COUNCIL MINUTES AND REPORTS RECEIVED AND FILED Mayor Struemph announced that the following minutes and reports have been received and are on file for review in the City Clerk’s office: a. Police Personnel Board, March 7, 2013 b. Certification of Cole and Callaway County April 2 Election Results to City Clerk c. CAMPO Technical Committee, March 7, 2013 d. Board of Adjustment, March 12, 2013 Mayor Struemph thanked all those members of the community who serve on these boards and commissions, and indicated how anyone interested in serving can access the Volunteer Profile form and submit it for consideration when vacancies occur. COUNCIL COMMITTEE REPORTS Administration Committee – Councilwoman Carrie Carroll announced that the last meeting was held Wednesday, March 27, at 8:00 A.M. Finance Committee - Councilman Shawn Schulte announced that last Finance Committee meeting was held Tuesday, March 26, at 7:30 A.M. Public Safety Committee – Councilman Bryan Pope announced that there was no report as no meeting had been held since the last Council meeting. Public Works & Planning Committee – Councilman Bob Scrivner announced that the last meeting was held on Thursday, March 21, at 7:30 A.M. Other Committee and Liaison Reports – There were no other reports given at this time. APPOINTMENTS BY THE MAYOR There were no appointments recommended at this time. PRESENTATIONS FROM STAFF, CONSULTANTS, AND INVITED GUESTS There were no presentations made at this time. 5 REGULAR COUNCIL MEETING, APRIL 15 2013 – FIRST MEETING CURRENT COUNCIL ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF Planning and Protective Services Director Janice McMillan announced the dates for this year’s annual Spring Bulky Item Pick-Up, also known as the “Spring Cleanup.” Areas east of Jefferson Street will be picked up beginning Monday, April 15, and west of Jefferson Street will be picked up beginning Monday, April 22. ITEMS BROUGHT UP OUT OF ORDER Mayor Struemph announced that the Council had voted in the 5:45 Pre-Meeting to amend the agenda to add Resolution RS2012-29 to the agenda and to take it up at this point in the Regular Meeting. RS2012-29 – Restoring Funding to Transit and Expressing Council’s Intent to Further Study Transportation Needs Following a brief explanation of this item by Councilman Bob Scrivner, who pointed out that even though his name was listed as sponsor, there were eight other Council Members who had requested to have their names listed as Co-Sponsors. Councilman Scrivner then made a motion for adoption of RS2012-29 as presented, seconded by Councilman Shawn Schulte. Councilman Bryan Pope made a motion to divide the resolution into two issues: (1) restore the funding, and (2) study the issue. The motion died for lack of a second. The original motion for adoption was then approved by the following roll-call vote: Aye: Bray, Carroll, Henry, Luebbert, Mihalevich, Prather, Schulte, Scrivner, and Weber Nay: Pope PRESENTATIONS FROM THE GALLERY ON SPECIFIC BILLS OR RESOLUTIONS Mr. Wayne Lee made a presentation and distributed a handout containing his suggestions for a commission to study the transportation issue as endorsed in Resolution RS2012-29 which the Council had just adopted. He stated his presentation is being made as a private citizen and not as a spokesperson for any group or organization. 6 REGULAR COUNCIL MEETING, APRIL 15 2013 – FIRST MEETING CURRENT COUNCIL Mr. Paul Vanhorn made a presentation regarding the transit issue and urged the Council Members to ride one of the City buses occasionally as a way to earn how the public utilizes the transit system. Ms. Heidi Lucas made a presentation to thank the Council for the action in restoring funding to the transit system in Resolution RS2012-29. Mr. Dave Griffith, former City Councilman, made a presentation stating his opposition to Bill 2012-159 concerning reducing the pay of the Mayor and Council Members. CONSENT AGENDA The following items were brought before the Council for approval by consent: a. Minutes of March 25, March 28, and April 1, 2013 City Council Meetings b. Contract Extension with All Seasons Home and Lawn Care, LLC, for Yard Waste Drop Off and Compost Operations A motion was made by Councilman Rick Prather for approval of the Consent Agenda as presented, seconded by Councilman Ralph Bray, and approved unanimously. BIDS OVER $50,000 There were no bids over $50,000 for consideration. Bill 2012-158 was read third time by title, placed on final passage and passed by the Ordinance 15103: following roll-call vote as Aye: Bray, Carroll, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None 2012-159 , sponsored by Councilman Pope, entitled: AN ORDINANCE AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, PERTAINING TO THE SALARY OF THE MAYOR AND CITY COUNCIL. Bill 2012-159 was read third time by title and placed on final passage. Councilman Bryan Pope made a motion to accept the substitute Bill 2012-159 previously distributed to the Council. The motion died for lack of a second. NEW BUSINESS 9 REGULAR COUNCIL MEETING, APRIL 15 2013 – FIRST MEETING CURRENT COUNCIL There was no new business brought forward. UNFINISHED BUSINESS Mayor Struemph made presentations of a plaque to each of the outgoing Councilmen: Councilman Bill Luebbert, Councilman Bryan Pope, and Councilman Bob Weber. After comments by the three outgoing Council Members, there were comments made by each of the remaining Council Members to thank them for their service to the City, and wish them well in future endeavors. APPROVAL OF CLOSED SESSION MINUTES A motion was made by Councilman Larry Henry to approve the April 1, 2013 Closed Session Minutes, seconded by Councilman Bryan Pope, and approved unanimously by the following roll-call vote: Aye: Bray, Carroll, Henry, Luebbert, Mihalevich, Pope, Prather, Schulte, Scrivner, and Weber Nay: None ADJOURN SINE DIE As no further business was brought before the Council for the 2012-2013 Council year, Mayor Struemph announced that there would be a short interval between this meeting and the First Meeting of the 2013-2014 Council to allow for the following elected officials th to be sworn into office by the Honorable Patricia S.
