REGULATIONS�RELATIVE TO PARKING OF VEHICLES UPON SUCH PUBLIC STREETS AND HIGHWAYS; PROVIDING FOR THE INSTALLATION, OPERATION AND MAIN- TENANCE, SUPERVISION, REGULATION AND CONTROL OF THE USE OF PARKING METERS; DEFINING AND PROVIDING FOR THE ESTABLISHMENT OF PARKING METER ZONES UPON THE PUBLIC STREETS AND HIGHWAYS; PROVIDING FOR -THE PAYMENT THEREOF AND FOR THE SUPPLY OF PARTS THEREFOR EXCLUSIVELY FROM THE RE- CEIPTS OBTAINED FROM THE OPERATION OF PARKING METERS; PROVIDING FOR THE ENFORCEMENT HEREOF AND PROVIDING PENALTIES FOR THE VIOLATION HEREOF. WHEREAS, the preservation and continued growth of the downtown area of the City of Richmond, Indiana, is important in providing retail and office employment for the citizens of the'City of Richmond; and, WHEREAS, the lack of parking facilities may have a detrimental effect upon the preservation and continued growth of the downtown area of the City of Richmond; and, WHEREAS, the City of Richmond is desirous of attempting to eliminate this ,parking problem in the downtown area of Richmond; and, WHEREAS; the City of Richmond is willing to attempt on a temporary basis to remove or cover parking meters on public streets and provide free on street parking with time limitation for the purpose of. testing and determining whether such free on street parking -will benefit the City of Richmond by aiding in the preservation and continued growth of the downtown Richmond area, NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA: SECTION 1. That Ordinance No. 1351-1948 be, and the same is hereby amended by creating and adding thereto a new section designated Section 19, said Section 19 to read as follows: Section 19.(a) The Board of Public Works and Safety is hereby em- powered and authorized to cause parking meters or any parts of parking meters located on or along any public streets and highways in the City of Richmond, Indiana to be covered or removed for the period of 92 days, commencing on October 1, 1965 and ending December 31, 1965. Operators'of vehicles parked adjacent to such parking meters so covered or removed, shall not be required to deposit any coin or pay any fee whatsoever for parking in such parking spaces. (b) The Board of Public Works and Safety is hereby authorized and empowered to establish during said period from October 1, 1965 to December 31, 1965, parking time limits upon any and all public streets or highways or portions thereof from which parking meters have been covered or removed in accordance with the "provisions of subsection (a) hereof. Whenever any parking time limit is imposed by the Board of Public Works and Safety in accordance herewith, it shall be the duty of the'Board of Public Works and Safety to cause to be erected appropriate signs giving notice of such parking time limits, and no such regulation shall be effective unless and until said signs are erected and in place. When such signs are erected giving notice of the parking time limit, no persons shall park a vehicle for longer than the period of time designated on any sign, and the parking of any vehicle in any such parking space for longer than the period of time designated on said sign shall be in violation of this ordinance. Police officers of the City of Richmond, Indiana, shall attach to any vehicle parked in violation of this ordinance, a notice to the owner or operator thereof that such vehicle has been parked in violation of this ordinance and instructing such owner or operator to report at the Office of the City Clerk in regard to such vio- lation. Such owner or operator may within forty-eight (48) hours of the time when such notice was attached to such vehicle, pay to the City Clerk as a penalty for and in full satisfaction of such violation the sum of One Dollar ($1.00). Provided further that if a fine for said violation shall -be paid on the same date and day of the violation thereof, the fine shall be only fifty cents (500). The failure of such owner or operator to make such payment within forty-eight (48) hours shall render such owner or operator subject, upon conviction thereof, to be fined any amount not exceeding Fifty Dollars ($50.00), for each violation, or im- prisonment for a term not exceeding fifteen days or both. (c) On the first day of January, 1966, or as soon there- after as may be :possible, the Board of Public Works and Safety shall cause to be replaced or uncovered on or along the .public streets and highways of the City of Richmond, Indiana, all the parking meters covered or removed by direction of said Board of Public Works and Safety in accordance with the provisions of subsection (a) hereof. Thereafter, operators of vehicles parked adjacent to such parking meters shall pay the required fee for such parking by depositing a coin in said parking meter in the same manner and for the same time limit as prescribed by Ordinance No. 1351-1948 and all or- dinances amendatory thereof or supplemental thereto. On the first day of January, 1966, or as soon thereafter as may be possible, the Board of Public Works and Safety shall also cause to be removed from the public streets and highways of the City of Richmond, Indiana, any and all signs designating parking time limits upon said streets and highways, which si ns were erected in accordance with the pro- visions of subsection hereof. (d) Nothing contained in the provisions of subsections (a), (b) and (c) hereof shall repeal or be taken or construed to repeal any of the provisions of Ordinance No. 1351-1948 or any pro- visions of any ordinances amendatory thereof or supplemental thereto, and the powers granted by the ,provisions of subsections (a), (b) and (c) hereof to the Board of Public Works and Safety shall be in addition to all other powers and duties granted to or imposed on the said Board of Public Works and Safety under the provisions of said Ordinance No. 1351-1948 and all ordinances amendatory thereof or supplemental thereto. SECTION 2. This ordinance shall be in full force and effect from and after its .passage, approval by the Mayor and publication as by law required.
