ORDINANCE NO. 2174 -1965
WHEREAS, in the operation of the Richmond Power & Light Plant
of the City of Richmond, Indiana (hereinafter referred to as "CITY"),
it appears necessary and desirable for the City to enter into a new
Agreement for an interconnection between the transmission line
facilities of Indiana & Michigan Electric Company (hereinafter referred
to as "COMPANY"), and the City's electric utility system; and
WHEREAS, the City -desires to enter into a written agreement
(hereinafter referred to a "AGREEMENT") with the Company setting
forth the terms, provisions and conditions with respect to such
interconnection and the service to be furnished thereby and the
charges therefor®
NOW, THEREFORE, be it ordained by the Common Council of the
City of Richmond, Indiana:
SECTION 1. The Agreement dated November 15 1965,
which is on file in the office of the City Clerk of the City of
Richmond, Indiana, and is by reference incorporated herein and
made a part hereof, be, and the same is hereby, approved and
confirmed.
SECTION 2® The City of Richmond, acting by and through its
Common Council now enters into, makes and executes the Agreement.
SECTION 3® The duly constituted officials and representatives
of the City be, and they are hereby, authorized and empowered to do
all acts and things, and to execute all instruments and papers,
necessary or expedient to fully carry out and perform on the part
of the City, the Agreement; provided however, that all monies to
be paid by the City to the Company under and pursuant to the Agree-
ment shall be payable only from the funds derived from the operation

of the City's municipal electric utility, Richmond Power & Light,
and shall not be payable from any funds appropriated or to be
appropriated under provisions of any budget law and shall not constitute
or be considered a corporate obligation of the City.
SECTION 4. This Ordinance shall be in full force and effect
from and after its passage and approval by the Mayor.
