HomeMy Public PortalAboutPolicy Resolution-14POLICY RESOLUTION NO. 14 POLICY RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA ESTABLISHING POLICY RELATIVE TO CANDIDATES' STATEMENTS, CANDIDATE INDIGENCY, RECOUNTS AND FILING FEE FOR MUNICIPAL PETITIONS, IN CONNECTION WITH THE CONDUCT OF MUNICIPAL ELECTIONS WHEREAS, pursuant to provisions of State law, the City Council has the authority to adopt local policies as to the conduct of municipal elections. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Napa as follows. Section 1. Pursuant to Elections Code Section 13307, policy in the matter of Candidates' Statements of Qualifications in connection with General Municipal Elections in the City of Napa is and the same is hereby established as follows: Each candidate may prepare a Candidate's Statement on the form provided by the City Clerk. 2. The Statement may include the name, age and occupation of the candidate and a brief description of no more than 200 words, of the candidate's education and qualifications expressed by the candidate himself or herself. 3. The Statement shall not include the party affiliation of the candidate, nor membership or activity in partisan political organizations. 4. The Statement shall be filed with the City Clerk at the time nomination papers are filed. Statements shall be typewritten in block style with no paragraph indents. No "bold", "underline" or "bullets" are permitted. The computer will correct spelling automatically. 5. The Word Count Standard as provided for in Section 9 of the State Elections Code is hereby adopted. 6. The Statement may be withdrawn but not changed during the period for filing nomination papers, and until 5:00 p.m. of the next working day after the close of the nomination period. Statements shall remain confidential until the expiration of the filing deadline. 7. Pursuant to State law, the Candidate's Statement must be translated and printed in Spanish at the candidate's request. 8. At the time of filing the Candidate's Statement, a fee in the amount of $200.00 shall be submitted by the candidate to cover his/her share of the cost of having his/her Statement included in the voter's pamphlet and the cost of translating the Statement into Spanish if requested. 9. The City Clerk shall have translated only those Statements into Spanish as requested by the Candidate. These Statements and the translation will be included in the sample ballot mailed to the voters. 10. The City Clerk shall have one Spanish translated version of the sample ballot and ballot available to a voter upon request. 11. No supplemental candidate campaign material shall be included with the sample ballot mailing. 12. Pursuant to Elections Code Section 13309, a candidate may file a statement of financial worth to verify indigency. If a candidate demonstrates indigency, the City will print the candidate's statement Policy Resolution No. 14 Page 1 of 2 in the sample ballot pamphlet without the candidate paying the statement fee in advance. The candidate will be required to repay the candidate's portion of the cost ($200.00). The City will use the U.S. Department of Housing and Urban Development (HUD) Very Low Income levels to determine whether a candidate is indigent. Section 2. That the Council adopts procedures for municipal recount pursuant to Elections Code Sections 10266 and 15600. Recount procedures can be initiated in three ways: (1) Clerk ordered, (2) voter requested, and (3) court ordered. Section 3. Pursuant to Elections Code Section 9202, policy in the matter of fee for initiative petitions is hereby adopted as follows: Any person filing a Notice of Intent with the City Clerk shall pay a fee in the amount of $200.00 to be refunded to the filer, if within one year of the date of filing the Notice of Intent; the City Clerk certifies the sufficiency of the petition. Section 4. That the City Clerk shall provide each candidate or the candidate's representative a copy of this Resolution at the time nominating petitions are issued. Section 5. This Policy Resolution shall apply at the next ensuing municipal election and at each municipal election after that time.
