POLICY RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NAPA, STATE OF CALIFORNIA, RESCINDING POLICY
RESOLUTION NOS. 19 AND 50 AND ESTABLISHING POLICY IN
THE MATTER OF ENCLOSING DRAINAGE DITCHES IN
SUBDIVISIONS AND OTHER LAND DEVELOPMENTS, AND
INSTALLATION OF STORM DRAINAGE PIPE IN OTHER AREAS
WHEREAS, there are numerous existing open drainage ditches in the City of
Napa and its immediate vicinity; and
WHEREAS, an open drainage ditch in an urban community is unsightly,
expensive to maintain and an unnecessary hazard to the residents of the urban community; and
WHEREAS, it is the desire of the City Council of the City of Napa to ultimately
effect enclosure of all drainage ditches within the City of Napa, with the exception of very large
creeks and rivers.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Napa, State of California, as follows:
Section 1. That Policy Resolution No. 19 adopted June 19, 1961 pertaining to
drainage pipe is hereby rescinded.
Section 2. That Policy Resolution No. 50 adopted October 24, 1966 pertaining
to enclosing drainage ditches in subdivision and other land developments is hereby rescinded.
Section 3. That policy in the matter of requirements for enclosing drainage
ditches in subdivisions and other land developments is hereby established as follows:
1. Enclosure, by means of underground drainage facilities, in' accordance
with the Public Works Department Standard Specifications and the master
plan for storm drainage, of all drainage ditches which pass through or
border either on common property lines or adjacent street rights-of-way
shall be a condition of approval of every application for subdivision or
other developments in the City of Napa.
2. Whenever it is determined by proper engineering analysis that without
improvement of downstream drainage facilities land proposed for
development will be subject to flooding or inundation to a greater degree
for severity than the minimum requirements set forth in the Public Works
Department Standard Specifications, approval will not be given unless
arrangements are made to provide downstream drainage facilities of
adequate capacity.
BE IT FURTHER RESOLVED, by the City Council of the City of Napa, that
policy in regard to installation of storm drainage pipe in other areas of the City is hereby
established as follows:
1. In situations where it appears unlikely that development approval will be
requested and the property owner is interested in enclosing an open
drainage ditch within the street right-of-way or in an easement area subject
to approval of the City Engineer and provided the property owner
dedicates all necessary easements and furnishes the required type and size
of pipe specified by the City Engineer, the City will install the pipe, or
have it installed at City expense within the limit of funds budgeted for that
purpose in the approved fiscal budget.
I HEREBY CERTIFY, that the foregoing resolution was duly and regularly
adopted by the City Council of the City of Napa at a regular meeting held on the 21st day of
July, 1987, by the following roll call vote:
