A POLICY RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA,
RE-ESTABLISHING POLICY FOR THE ISSUANCE OF SEPARATE GRADING
PERMITS UNDER APPENDIX CHAPTER 70 OF THE UNIFORM BUILDING
CODE
WHEREAS, appendix Chapter 70 of the Uniform Building Code (UBC), adopted by Chapter 15
of the Napa Municipal Code, regulates grading work on private property and requires a grading permit
to be issued by the Chief Building Inspector for all grading activities, excepting minor work as set forth
in said Chapter 70; and
WHEREAS, said UBC Chapter 70 and other provisions of the Municipal Code do not preclude
grading plan approval, permit issuance or commencement of grading work prior to, or during project
application processing by the City; and
WHEREAS, such premature grading work may compromise necessary conditioning of the project
permit at the time of final approval by the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council as follows:
Section 1. A grading permit shall not be issued for grading work, nor shall any grading occur,
on any property prior to project application; or while a project application for the property is under
consideration by the City.
Section 2. Following project approval by the City, as defined herein, for the purposes of this
resolution only, and final approval of the grading plan(s) by the Public Works Director, upon request of
the applicant a separate grading permit may be issued by the Chief Building Inspector prior to issuance
of a building permit or approval of the Final Subdivision Map.
For subdivisions, project approval is final approval by the City Council of the
tentative subdivision map.
b. For projects requiring use permits, project approval is expiration of the statutory
appeal period with no appeal having been filed, or final approval of the use
permit by the City Council.
Section 3. Upon a finding of no significance by the Public Works Director, a grading permit may
be issued for minor work, Sections 1 and 2 of this resolution notwithstanding.
I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the
Council of the City of Napa at a regular meeting of said City Council held on the 3rd day of October,
1995, by the following roll call vote:
