HomeMy Public PortalAbout2012.142 (07-17-12)RESOLUTION NO. 2012.142 A RESOLUTION AMENDING THE CITY'S FEE SCHEDULE TO INCREASE THE ENTERPRISE ZONE HIRING TAX CREDIT VOUCHER APPLICATION FEE AND ESTABLISH AN OPTIONAL FEE FOR EXPEDITING THE APPLICATION REVIEW PROCESS WHEREAS, July 17, 2012, the City of Lynwood held a duly noticed Public hearing as required by law to consider a increase for the Enterprise Zone Hiring Tax Credit Application Fee and establish an optional expediting fee; and WHEREAS, pursuant to the passage of SB 856, the State Department of Housing and Community Development assess local municipalities a $15 remittance fee per application processed; and WHEREAS, the proposed Enterprise Zone Tax Credit Hiring Voucher Application Fee of $75 will defray the cost incurred by the Community Development Department to administer the program and pay the State required $15 fee; and WHEREAS, an optional fee of $25 per application be added to the Master Fee Schedule for applicants who request an expedited review of their submitted hiring voucher application. This fee will be in addition to the regular processing fee of $75; and WHEREAS, the City will collect the proposed $75 Hiring Credit Voucher Application Fee for each application submitted and the optional expediting fee of $25. The State imposed fee of $15 will be paid directly to the governing State department on a monthly basis and the remaining $60 will be deposited into an Enterprise Zone revenue account within the Community Development Department budget. A separate expenditure account will be required to pay for the administrative costs of the program under the Community Development Department budget. These costs include marketing of the Enterprise Zone Program, staff training and development for the EZ, consulting services for the program, and EZ staff salaries. Staff includes the Vouchering Coordinator and Enterprise Zone Manager. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. That the fee does not exceed the reasonable cost of paying the fee charged to the City by the State Department of Housing and Community Development and the Community Development Department's cost for reviewing and processing the Hiring Tax Credit Voucher Application. Section 2. The City Council hereby increases the Enterprise Zone Hiring Tax Credit Application fee to $75 and establishes an optional expediting fee of $25. Section 3. The City will collect the proposed $75 Hiring Tax Credit Voucher Application Fee for each application submitted and the optional expediting fee.
