HomeMy Public PortalAboutResolution 90-1579 PC" " " RESOLUTION NO. 90- 1579PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING VARIANCE /CONDITIONAL USE PERMIT 90 -1071, A REQUEST BY ANTHONY BASILE, JR., TO ALLOW THE CONSTRUCTION OF AN ADDITION TO AN EXISTING SINGLE FAMILY HOME WITH A FLOOR AREA RATIO OF .45 RATHER THAN THE ALLOWED .35 F.A.R. IN THE SINGLE FAMILY RESIDENTIAL (R -1) ZONE FOR PROPERTY LOCATED AT 4505 TEMPLE CITY BOULE- VARD. (BASILE) The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing for the above Vari- ance /Conditional Use Permit, the Planning Commission makes the following findings: VARIANCE 1. That there are exceptional and extraordinary circum- stances or conditions applicable to the property which do not generally apply to other properties in the same zone in that the subject site contains 6,100 square feet of area as opposed to the minimum size of 7,200 square feet and the existing improvements on the lot severely limits the possibilities for an addition; and 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated but which is denied to the property in question in that the proposed two -story addition is compatible to the surrounding properties; and 3. That the granting of the variance will not be materi- ally detrimental to the public welfare or injurious to adjacent property in that the proposed configuration of the addition allows for private open space /setback in the rear yard and the project abuts a two -story commer- cial office building. Although the property abuts an R -1 use to the west, the subject property is situated along a major thoroughfare; and 4. That there are special circumstances as provided in Section 65906 of the California Government Code in that the subject lot is substandard in size and building expansion potential is severely limited by the existing improvements. Resolution No. 90- 1579PC Page 2 Variance /Conditional Use Permit 90 -1071 CONDITIONAL USE PERMIT 1. That the site for the proposed use is adequate in size, shape, topography and circumstances in that the subject lot is situated along a major thoroughfare, the lot is generally level in grade and the proposed construction project is consistent with improvements on adjacent and surrounding properties; and 2. That the site has sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that the subject lot is situated on Temple City Boulevard, a major thoroughfare, which is designated as a primary circu- lation corridor on the City's adopted General Plan; and 3. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare in that the subject lot is abutted to the north by a two -story office building and is separated from properties to the east by Temple City Boulevard; although, the lot is abutted by an R -1 zoned parcel to the west, the dwelling is oriented toward the east. Section 2. This project is categorically exempt from envi- ronmental review in accordance with the State CEQA Guidelines. Section 3. Accordingly, Variance /Conditional Use Permit 90 -1071 is approved, subject to the following conditions: 1. Approval shall not be effective until Ordinance No. 90 -672 becomes effective and the 10 -day appeal period has passed. No building permits shall be issued before December 21, 1990. 2. Construction shall be completed in substantial compliance with submitted development plans, except as modified herein. 3. The exterior building facades shall be modified to provide for an integrated structural appearance. Specifically, the facade shall be modified so that the second story does not appear to be an addition. The finished dwelling should consist of well integrated and complimentary components. Final building plans shall be subject to review by the Planning Department. 4. The existing full grown tree on the lot, between the house and Temple City Boulevard shall be preserved and two (2) additional 15 gallon trees shall be planted on the property. Street trees shall be provided as may be required by Park Maintenance Superintendent. • " " " Resolution No. 90- 1579PC Page 3 Variance /Conditional Use Permit 90 -1071 5. No construction activity waste materials of any kind includ- ing plaster, cement, paint, mud or any other type of debris or liquid shall be allowed to be disposed of in the street or gutter or storm drain or sewer system. Failure to comply with this condition will result in charges being filed with the District Attorney. (TCMC 3400 -3411) 6. Prior to issuance of a building permit, plans shall be reviewed and approved by the Planning and Public Works Departments. 7. A roll -type garage door with automatic garage door opener shall be installed and continuously maintained to serve the subject single family house. Section 4. The Secretary shall certify to the adoption of this Resolution.
