HomeMy Public PortalAboutResolution 91-1584 PC" RESOLUTION 91- 1584PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING A ZONING CODE AMENDMENT TO DELETE THE CURRENT PROHIBI- TION AGAINST FORTUNE TELLING AS A HOME OCCU- PATION AND TO STRENGTHEN THE CURRENT PROHIBITION AGAINST HOME OCCUPATION RELATED SIGNAGE AND TO REQUIRE A CONDITIONAL USE PERMIT FOR ANY HOME OCCUPATION WITHIN 300 FEET OF A MAJOR THOROUGHFARE OR A COMMERCIAL OR MANUFACTURING ZONE. The Planning Commission of Temple City does hereby resolve as follows: Section 1. Based upon a public hearing to consider the above referenced Zoning Code amendment, the Planning Commission finds: 1. The intent of permitted home occupations is to provide for gainful employment and business opportunities by occupants of dwellings which are incidental to and compatible with residential uses; and 2. Residentially zoned areas situated along or within 300 feet of a major thoroughfare or within 300 feet of a commercial or manufacturing zone create a certain poten- tial for incompatible land uses and possible pressure for re- zoning; and 3. A proliferation of home occupations along major thorough- fares or within 300 feet of major thoroughfares or in proximity to commercial or manufacturing areas provides a opportunity for home occupations which are not consistent with the intended purpose of this permitted accessory use; and 4. A rather visible abuse of the intended purpose of a home occupation is the possible installation or erection of signage which introduces a commercial feature in an other- wise residential neighborhood; therefore, a more stringent prohibition against possible use of signage in connection with the home occupation would help to ensure that home occupations are consistent with the nature and character of residentially zoned properties; and 5. A home occupation located along or within proximity of a major thoroughfare or commercial or manufacturing zone could significantly, adversely impact traffic circulation and parking which is already at a substandard condition; a conditional use permit of home occupations within 300 feet of a major thoroughfare or commercial or manufacturing zone would help to ensure that adverse impacts associated with home occupations would be minimized and would not have a cumulative adverse affect on those areas. It has been determined that the subject zoning code amendment would not have any significant adverse affect upon the environment; therefore, a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. Section 3. The Planning Commission recommends that the Zoning Code be amended as follows: 9117. "H" SECTION. Home Occupation G. there is no use of any sign not otherwise permitted in the zone in which the occupation is located; no signaqe whatsoever shall be permitted in conjunction with the home occupation. Evidence of a violation of this prohibition against home occupation related signaqe shall be grounds for revocation or suspension of all applicable permits. H---- €ertune telling shall net be permitted as a heme eeetpat4ea- a Conditional Use Permit shall be required for any home occupation within 300 feet of any major thor- oughfare identified as a primary or secondary street on the City's adopted General Plan or within 300 feet of a Commercial or Manufacturing Zone. (Any licensed home occupation within the areas specified herein as of the effective date of this ordinance shall be deemed to have a valid conditional use permit, pro- vided said home occupation complies with all other provisions which define and regulate a home occupa- tion) 9202. CONDITIONAL USE PERMITS. WHEN REQUIRED. Home occupation, only in an "R" Zone, within 300 feet of any major thoroughfare identified as a primary or secon- dary street on the City's adopted General Plan or within 300 feet of a Commercial or Manufacturing Zone. (See Section 9117 (H)) PART XIII - RESIDENTIAL DISTRICTS DIVISION I - R -1 9331. PERMITTED USES. B. Accessory Uses. 8.
