A RESOLUTION OF THE PLANNING COMMISSION OF
.THE CITY OF TEMPLE CITY APPROVING ZONE
VARIANCE 91 -1089 A REQUEST BY PAUL PIERCE
TO ALLOW THE CONTINUATION OF AN EXISTING
4 FOOT SIDE YARD SETBACK FOR THE FIRST
FLOOR OF A TWO STORY DWELLING RATHER THAN
THE REQUIRED 5 FOOT SIDE YARD SETBACK FOR A
SINGLE FAMILY RESIDENCE IN THE R -1 ZONE FOR
PROPERTY LOCATED AT 5742 GOLDEN WEST
AVENUE. (PIERCE).
The Planning Commission of the City of Temple City does
hereby resolve:
Section 1. Based upon a public hearing for the above Zone
Variance, the Planning Commission finds:
1. That there are exceptional and extraordinary circumstances
or conditions applicable to the property which do not
generally apply to other properties in the same zone in
that the site has a width of 50 feet and a depth of 190
feet; the lot width is substandard and does not allow
flexibility for expansion; and
2. That such variance is necessary for the preservation and
enjoyment of a substantial property right possessed by
other property similarly situated but which is denied to
the property in question in that the subject lot currently
has a 4 foot side yard setback on the north side of the
property; other dwellings in the R -1 Zone in the immediate
area have side yards less than the current minimum of five
feet. A single story dwelling may extend an existing
non - conforming side yard setback; This project differs
from other similar projects in that it consists of a
two -story dwelling rather than a single . story dwelling.
The second story of the proposed dwelling, however, com-
plies with the side yard setback standard; and
3. That the granting of the variance will not be materially
detrimental to the public welfare or injurious to adjacent
property in that the subject variance would allow for an
extension of an existing 4 foot side yard condition which
would have a negligible impact upon abutting and surround-
ing properties; the subject variance relates only to the
first story portion of the proposed two - story dwelling
which is less significant than a second story setback; the
applicant proposes to exceed the minimum second story
setback by providing a building setback of 10 feet from
the north property line; and

4. That there are special circumstances as provided in Sec-
tion 65906 of the California Government Code in that the
subject lot is rather narrow and the existing side yard
setback is 4 foot and a denial of the variance would
result in an unusual building line which would detract
from the aesthetic quality of the house.
Section 2. This project is categorically exempt from
environmental review in accordance with the State CEQA Guide-
lines.
Section 3. Accordingly, Zone Variance No. 91 -1089 is
approved.
Section 4. The Secretary shall certify to the adoption of
this Resolution.
I certify that the foregoing Resolution was duly adopted
by the Planning Commission of the City of Temple City on the
day of 11th day of June, 1991, by the following vote:
AYES: Commissioner- Budds ,Floyd,Muto,Seibert,Griffiths
