HomeMy Public PortalAboutResolution 91-1604 PC" " RESOLUTION NO. 91- 1604PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY MAKING A FRONT YARD DETERMINATION AND APPROVING A REQUEST BY KATHLEEN CARLE, FOR ZONE VARIANCE. 91 -1090 TO ALLOW A ROOM ADDITION TO AN EXISTING RESIDENCE WITHOUT THE REQUIRED 500 SQUARE, FEET OF OPEN SPACE LOCATED IN THE MULTIPLE FAMILY (R -2) ZONE FOR PROPERTY LOCATED AT 5521 WELLAND AVENUE. (CARLE) The Planning Commission of the City of Temple City does hereby resolve: Section 1. The Planning Commission hereby determines that the front yard of the existing tiered lot shall be the south portion of the lot and that the rear yard shall be the northern portion of the lot and that the east and west sides shall be considered side yards. Section 2. Based upon a public hearing for the above Zone Variance, the Planning Commission finds: 1. That there are exceptional and extraordinary circum- stances or conditions applicable to the property which do not generally apply to other properties in the same zone in that the site is 77 feet by 71.66 feet, which provides a total lot size of 5,087.66 square feet which is substantially smaller than the current minimum lot size requirement of 7,200 square feet; and 2. That such a variance is necessary for the preserva- tion and enjoyment of a substantial property right possessed by other property similarly situated but which is denied to the property in question in that the present dwelling configuration allows a minimum amount of expansion possibilities which other proper- ties enjoy; and 3. That the granting of the variance will not be materi- ally detrimental to the public welfare or injurious to adjacent property in that the impact of the addi- tion is mitigated due to the fact that it is not visible from the street and is buffered from abutting properties by the use of dense vegetation; and 4. That there are special circumstances as provided in Section 65906 of the California Government Code in that the subject lot is located at the rear of a tiered lot and is smaller than the minimum lot size requirement of 7,200 square feet. Resolution No. 91- 1604PC Page 2 Zone Variance 91 -1090 Section 2. This project is categorically exempt from environmental review in accordance with the State CEQA Guide- lines. Section 3. Accordingly, Zone Variance 91 -1090 is approved, subject to the following conditions of approval: 1. That the proposed development' is in substantial com- pliance with the submitted development plans date stamped May 29, 1991. 2. That all development standards applicable to single family construction as defined in Section 9352 of the Temple City Zoning Code be adhered to at all times. 3. No construction activity waste material of any kind, including plaster, cement, paint, mud or any other type of debris or liquid shall be allowed to be disposed of in the street or gutter or storm drain or sewer system. Failure to comply with this condition will result in charges being filed with the District Attorney. (TCMC 3400 -3411) 4. Prior to issuance of a building permit, plans shall be reviewed and approved by the Public Works and Community Development Department. Section 4. The Secretary shall certify to the adoption of this Resolution.
