HomeMy Public PortalAboutResolution 91-1611 PC" " RESOLUTION NO. 91- 1611PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY MAKING A FRONT YARD DETERMINATION AND APPROVING ZONE VARIANCE 91 -1094 A REQUEST BY JOHN BRUMMELKAMP TO ALLOW A 4 FOOT SIDE YARD SETBACK FOR BOTH THE FRONT AND SECOND STORY OF A NEW TWO STORY ADDITION TO A SINGLE FAMILY RESIDENCE IN THE R -1 ZONE FOR PROPERTY LOCATED AT 6251 PRIMROSE. (BRUMMELKAMP) The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing for the above Zone Variance, the Planning Commission finds: 1. That there are exceptional and extraordinary circum- stances or conditions applicable to the property which do not generally apply to other properties in the same zone in that the site is substandard in size and irregular in shape which makes it difficult to accommodate an addition which would comply with the minimum code requirements; and 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated but which is denied to the property in question in that other similarly zoned properties are able to construct two story room additions and meet the standards because their lots are more rec- tangular in shape; and 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to adja- cent property in that the lot is located on a corner and the portion of the dwelling which does not meet the side yard setback is abutted by a school playground and would have no significant impact; and 4. That there are special circumstances as provided in Section 65906 of the California Government Code in that the subject property is irregular in shape and contains less than the minimum required lot area of 7,200 square feet. Section 2. This project is categorically exempt from environmental review in accordance with the State CEQA Guide- lines. " Section 3. Accordingly, Zone Variance No. 91 -1094 is approved subject to the following conditions: RESOLUTION NO. 91- 1611PC PAGE 2 ZONE VARIANCE 91 -1094 1. That the proposed development is in substantial compliance with the submitted development plans date stamped July 2, 1991, and labelled as Exhibit "A ", except as modified herein. 2. That all development standards applicable to single family construction as defined in Section 9333 of the Temple City Zoning Code be adhered to at all times. 3. No construction activity waste material of any kind, including plaster, cement, paint mud or any other type of debris or liquid shall be allowed to be disposed of in the street or gutter or storm drain or sewer system. Failure to comply wit this condition will result in charges being filed with the District Attorney. (TCMC 3400 -3411) 4. One tree no less than 15 gallon in size shall be planted adjacent to the south building wall of the proposed two - story addition. Section 4. The Secretary shall certify to the adoption of this Resolution.
