HomeMy Public PortalAboutResolution 91-1618 PC" " RESOLUTION NO. 91- 1618PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY DENYING CONDITIONAL USE PERMIT 91 -1100 AND ZONE VARIANCE 91 -1101 A REQUEST BY ROKEL ENTERPRISES, INC. TO ALLOW THE DIVISION OF AN EXISTING 35 FOOT WIDE COMMERCIAL BUILDING INTO TWO GROUND LEVEL UNITS, ONE OF WHICH WOULD BE UTILIZED FOR BUSINESS AND PROFESSIONAL OFFICE USE WITHOUT PROVIDING THE REQUIRED SIX PARKING SPACES FOR PROPERTY LOCATED IN THE RETAIL COMMERCIAL (C -1) ZONE. The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing for the above Conditional Use Permit and Zone Variance, the Planning Commis- sion finds: CONDITIONAL USE PERMIT 1. That the site for the proposed use is not adequate in size, shape, topography and circumstances in that the site has a width of 34.95 feet and a length of 110 feet for a total land area of approximately 3,844 square feet of which 3,844 square feet is covered by a commercial build- ing for a lot coverage factor of 100%; and 2. That the site does not have sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that the division of the building into additional commercial units will result in an increase in the amount of traffic; and 3. That the proposed use will have an adverse effect upon the use, enjoyment and valuation of adjacent property or upon the public welfare in that the creation of an additional unit will further increase the need for off - street park- ing; the creation of an additional commercial unit to be utilized for office purposes could adversely impact other uses in the immediate area which share the rather limited amount of available off - street parking. ZONE VARIANCE 1. That there are no exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of such property which do not generally apply to other properties in the same zone in that the subject property is comparable in size and width Resolution No. 91- 1618PC Conditional Use Permit 91 -1100 Zone Variance 91 -1101 Page 2 to other properties in the immediate area and that other properties utilize their entire ground floor area for permitted retail and service uses; and 2. That such variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated but which is denied to the property in question in that the property owner may utilize the entire ground floor space for any permitted retail use without subdividing the existing store into two units; and other similarly zoned and improved properties have not been allowed to be divided into additional com- mercial units; and 3. That the granting of the variance will be materially detrimental to the public welfare or injurious to adjacent property in that the creation of an additional commercial unit would create an additional demand for parking, which would adversely impact surrounding businesses in the immediate area. Additionally, the proposed office use would not contribute to the retail nature of the C -1 Zone; and 4. That there are no special circumstances as provided in Section 65906 of the California Government Code in that the property is not of any unusual size or shape which would warrant the granting of a variance. Section 2. This project should not result in any signifi- cant effect upon the environment and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no poten- tial for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. Section 3. Accordingly, Conditional Use Permit 91 -1100 and Zone Variance No. 91 -1101 are denied. Section 4.
