HomeMy Public PortalAboutResolution 91-1624 PC" RESOLUTION 91- 1624PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING MODIFICA- TION OF VESTING TENTATIVE PARCEL MAP 20849 A REQUEST BY MAHADEVA AND CHANDRA SIHNA TO MODIFY A CONDITION OF APPROVAL REGARDING THE RELOCATION OF THE SEWER LINE IN THE SINGLE FAMILY RESIDENTIAL (R -1) ZONE LOCATED AT 9725 OLIVE STREET. The Planning Commission of Temple City does hereby re- solve: Section 1. Based upon a public hearing for a Modifica- tion to Vesting Tentative Parcel Map as described above the Planning Commission finds: VESTING TENTATIVE PARCEL MAP 1. That the design and improvement of the proposed subdivi- sion is consistent with the City's General Plan, Zoning and requirements of the State Subdivision Map Act. 2. That the site is physically suitable for the proposed type " of development and proposed density of development. 3. That the design of the subdivision and the type of im- provement will not conflict with the easements acquired by the public at large for access through or use of property within the proposed subdivision. 4. That the sewer discharge from the proposed subdivision would not result in a violation of existing requirements prescribed by the California Regional Water Quality Con- trol Board pursuant to Division 7 of the Water Code. Section 2. This project should not result in any sig- nificant effects upon the environment and is categorically exempt in accordance with the State CEQA Guidelines. Section 3. Accordingly, the Modification to Vesting Tentative Parcel Map No. 20849 is approved and Condition No. 6 of Planning Commission Resolution No. 89- 1489PC is hereby modified as follows: " Condition No. 6: Prior to recordation of the final map, a covenant and agreement shall be recorded specifying that prior to the time of sale of either Lot 1 or Lot 2 or prior to the issuance of the building permit for improvements to Lot 1, the existing sewer lateral serving the existing house on Lot 2 shall be relocated so as not to encroach upon Lot 1. Said Resolution 91- 1624PC Page 2 Vesting Tentative Parcel No. 20849 covenant and agreement shall be subject to the review and ap- proval of the City Attorney and Community Development Director. Section 4. Except for the modification as approved in Section 3 above, all other conditions of Resolution No. 89- 1489PC shall remain in effect. Section 5. The Secretary shall certify to the adoption of this Resolution.
