HomeMy Public PortalAboutResolution 91-1628 PC" " RESOLUTION NO. 91- 1628PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING CONDI- TIONAL USE PERMIT 91 -1110, A REQUEST BY MR. & MRS. JAMES SCINTA TO ALLOW THE CONSTRUC- TION OF A NEW TWO -STORY SINGLE FAMILY RESIDENCE WITH A FLOOR AREA RATIO OF .38 RATHER THAN THE ALLOWED .35 F.A.R. IN THE SINGLE - FAMILY RESIDENTIAL (R -1) ZONE FOR PROPERTY LOCATED AT 9842 FLAHERTY ( SCINTA) The Planning Commission of the City of Temple City does hereby resolve: Section 1. Based upon a public hearing for the above Conditional Use Permit, the Planning Commission makes the following findings: CONDITIONAL USE PERMIT 1. That the site for the proposed use is adequate in size, shape, topography and circumstances in that the subject lot contains 8,279 square feet of area, which would allow a dwelling of up to 2,897 square feet of living area; the proposed dwelling exceeds the F.A.R. standard only by virtue of a vaulted ceiling area, which does not add additional bulk from the exterior; and 2. That the site has sufficient access to streets and high- ways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that the subject lot is situated on Flaherty Avenue, a local street with 60 feet of public right -of -way and 40 feet of roadway; and 3. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare in that the proposed dwelling would appear to be the same size from the exterior; the amount of square footage over the .35 F.A.R. is a result of a vaulted ceiling area, which would have been attic space had this request been denied. Section 2. This project is categorically exempt from environmental review in accordance with the State CEQA Guide- lines per Section 15301, Class 1. Section 3. Accordingly, Conditional Use Permit 91 -1110 is approved, subject to a condition that the dwelling be constructed in substantial compliance with the submitted devel- opment plans.
