HomeMy Public PortalAboutResolution 92-1634 PC" " RESOLUTION NO. 92- 1634PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING CONDITIONAL USE PERMIT 91 -1116, A REQUEST BY GLENNA KRUSE TO ALLOW A HOME OCCUPATION BUSINESS LICENSE FOR A DIRECT SALES COSMETICS COMPANY (JAFRA) LOCATED AT 10018 DAINES DRIVE IN THE SINGLE FAMILY (R -1) ZONE. (KRUSE) The Planning Commission of Temple City does hereby re- solve: Section 1. Based upon a public hearing for a Condi- tional Use Permit, the Planning Commission finds: CONDITIONAL USE PERMIT 1. That the site for the proposed use is adequate in size, shape, topography and circumstances in that the subject lot has a width of 53 feet and a depth of 132 feet, for a total land area of approximately 6,996 square feet; and 2. That the site has sufficient access to streets and high- ways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that the subject lot is situated on Daines Drive with 60 feet of public right -of -way and 40 feet of road- way; and 3. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare in that the proposed home office use is located and screened in a manner which does not affect the adjacent properties and is consistent with all home occupation standards. Section 2. This project is Categorically Exempt from environmental review in accordance with the State CEQA Guide- lines per Section 15301, Class 1. Section 3. Accordingly, Conditional Use Permit 91 -1116 is approved, subject to the following conditions: 1. The home occupation shall at all times comply with Section 9117(H) of the Temple City Zoning Code, as detailed below: Home Occupation shall mean an occupation, calling or pro- fession carried on by an occupant of a dwelling unit, located in an "R" zone, as an accessory use, in connection with which: Resolution 92- 1634PC Page 2 Conditional Use Permit 91 -1116 A. there is no display or storage of goods, wares, mer- chandise, or stock in trade maintained on the prem- ises; and B. there is not more than one person regularly employed in such occupation; and C. there is no equipment used in conjunction with such occupation, which emits dust, fumes, noise, odor, etc., which would or could interfere with the peace- ful use and enjoyment of adjacent properties; and D. there is not more than 200 square feet of floor space of the dwelling devoted to such uses; and E. there is no appreciable increase of traffic, pedes- trian and vehicular, by reason of such occupation, calling or profession; and F. there is no alteration of the structure; and G. there is no use of any sign not otherwise permitted in the zone in which the occupation is located; no signage whatsoever shall be permitted in conjunction with the home occupation. Evidence of a violation of this prohibition against home occupation related signage shall be grounds for revocation or suspension of all applicable permits. H. a conditional use permit shall be required for any home occupation within 300 feet of any major thor- oughfare identified as a primary or secondary street on the City's adopted General Plan or within 300 feet of a commercial or manufacturing zone. Any licensed home occupation within the areas specified herein as of the 8th of March, 1991, shall be deemed to have a valid conditional use permit, provided said home occupation complies with all other provisions which define and regulate a home occupation. 2. This home occupation business license shall not be trans- ferable with the property. Said business license shall only be valid for the current applicant /property owner. Section 4.
