A RESOLUTION REQUESTING TENTATIVE ADOPTION OF AMENDED
CHAPTER 54 OF THE RICHMOND CODE REGARDING PRETREATMENT
SEWER USAGE, AND ITS ACCOMPANYING ENFORCEMENT RESPONSE
GUIDE (ERG)
WHEREAS, Chapter 54 of the Richmond Code currently sets forth certain ordinances
regulating pretreatment sewer usage for users of the Richmond Sanitary
District, along with general sewer use ordinances; and
WHEREAS, in connection with the City of Richmond's National Pollutant Discharge
Elimination System ( NPDES) permit renewal effective March 1, 2011,
extensive revision of Chapter 54 pretreatment ordinances and the ERG
were required for submission to the EPA for approval; and
WHEREAS, the City of Richmond's NPDES permit requires a re- evaluation of our
mandated pretreatment program; and
WHEREAS, in connection with this revision, it is deemed efficient, reasonable, and
necessary to separate out those ordinances which pertain to general sewer
usage from those which pertain to mainly industrial pretreatment sewer
usage, for their better understanding and enforcement by those subject to
them; and
WHEREAS, the general sewer usage ordinances were previously contained in Chapter
50 of the Richmond Code of General Ordinances, which was eliminated by
Ordinance No. 69 -1997 amending Chapter 54;
WHEREAS, the general sewer use ordinances have been updated to account for various
changes in the requirements necessary to address the orderly and efficient
provision of general sewer services within the Richmond Sanitary District,
and are now contained in a new Chapter 50 being recommended for
adoption by the Richmond Common Council by Resolution No. 11 -2011;
and
WHEREAS, Chapter 54 has been revised to set forth changed pollutant limits, language,
and procedures as mandated by the terms of the City's permit and the EPA;
and
WHEREAS, the passage of amended Chapter 54 of the Richmond Code and the
Enforcement Response Guide by the Richmond Common Council would be
tentative, subject to public hearing and approval by the EPA before final
adoption of the same; and
WHEREAS, Indiana Code 36- 9 -25 -10 empowers the Board of Commissioners of the
Richmond Sanitary Commissioners to compel owners, operators, or lessees

of all factories, shops, works, plants, or other structures to treat, purify, or
eliminate from the sewage and trade waste of the premises any ingredients
that interfere with the successful operation of the sewage works, and to
review and approve plans for privately constructed plants for the treatment
or elimination of trade waste.
NOW, THEREFORE, BE IT RESOLVED by the Richmond Board of Sanitary
Commissioners that Richmond's Common Council be requested to amend Chapter 54 of
the Richmond Code (PRETREATMENT SEWER USAGE) and enact the Enforcement
Response Guide (ERG) as attached hereto.
