HomeMy Public PortalAboutResolution 92-1655 PC" " RESOLUTION NO. 92-1655PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING ZONE VARIANCE 92 -1138, A REQUEST BY WILLIAM J. OWEN TO BUILD A NEW TWO -STORY SINGLE FAMILY DWELLING ON AN EXISTING NON - CONFORMING R -1 ZONED PROPERTY LOCATED AT 5329 -1/2 GOLDEN WEST AVENUE IN THE SINGLE FAMILY (R -1) ZONE. (OWEN) The Planning Commission of the City of Temple City does hereby resolve: SECTION 1. Based upon a public hearing for the above Zone Variance, the Planning Commission finds: ZONE VARIANCE 1. That there are exceptional and extraordinary circumstances or conditions applicable to the property involved or to the intended use of such property which do not generally apply to other properties in the same zone in that the property is 75 feet in width and 365 feet in depth, with a total area of 27,375 square feet, which would allow for 3.8 units in accordance with General Plan density; and 2. That such variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated but which is denied to the property in question in that the new two -story dwelling would provide upgraded housing stock and will preserve the single family nature of the neighborhood. Additionally, a covenant deed restriction not allowing any expansion to the non- conformity except for the principal dwelling would help ensure a single family character on the site; and 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to adjacent property in that the site is currently improved with four dwelling units and the proposed replacement of the front dwelling with a new dwelling would not increase the non- conformity or adversely affect the neighborhood; and 4. That there are special circumstances as provided in Section 65906 of the California Government Code in that the subject lot is rectangular in shape and generally level in grade and does possess unique features relative to the size, shape or topography. The proposed modification to the existing R -1 zoned lot to construct a two -story dwelling will not intensify the existing condition. The subject lot is nearly four times larger than the minimum size established by the Zoning Code for the R -1 Zone. Resolution No. 92- 1655PC Zone Variance 92 -1138 Page 2 SECTION 2. This project is Categorically Exempt from an environmental review in accordance with the State CEQA guidelines. SECTION 3. Accordingly, Zone Variance 92 -1138 is approved, subject to the following conditions: PLANNING 1. The proposed development shall be in substantial compliance with the submitted development plans dated stamped April 28, 1992, except as modified herein. 2. All development standards applicable to residential construction as defined in Section 9330 of the Temple City Zoning Code shall be adhered to at all times. 3. The property owner shall obtain a building permit for all construction and demolition. Prior to issuance of building permits, plans shall be reviewed and approved by Public Works, Building and Safety and Community Development Department. 4. Any two of the three non - conforming units on the subject property shall be abated within 10 years of this approval date in a manner to make the original remaining in conformance with the flag lot requirements. The applicant shall sign a covenant and deed restriction running with the land and enforceable by the City at the cost of the applicant acknowledging the abatement amortization period prior to issuance of building permits. 5. Nothing in this approval shall extend or alter the non- conforming status of the subject use or the scheduled abatement thereof. 6. The applicant shall construct and locate three additional outdoor parking spaces for the three rear units, subject to the review and approval by the Community Development Department. 7. The three existing dwellings toward the rear of the property shall be re- painted prior to final building inspection approval for the proposed new dwelling at the front of the lot. 8. The principle dwelling is determined to be the front dwelling unit closest to Golden West Avenue. The three existing dwellings located toward the rear of the lot shall be non - conforming. • • " Resolution No. 92- 1655PC Page 3 Zone Variance 92 -1138 " " PUBLIC WORKS 9. Curbs, gutters, sidewalks: Remove and replace north drive approach, install new 5 foot wide PCC sidewalk adjacent to property line across Golden West Avenue frontage of lot. Remove and replace broken curb and gutter as necessary to restore proper gutter flow line and even curb face. 10. Street Lights: Not required; existing light opposite site. 11. Street Trees: Protect in place existing street tree. Provide root barrier. 12. Surface Drainage: Provide all facilities necessary to accommodate contributory runoff and all surface drainage from the subject property and conduct it into appropriate storm drain facilities. no runoff shall be allowed to run over a sidewalk. 13. Sewers: Provide sewers per Code requirements. 14. Utilities: Prior to issuance of building permits, provide Public Works with a detailed utility plan for review and approval showing all utility pipes, wires and conduits and their respective points of connection. 15. Dedications: None required. 16. Permits: Show on plot plan all right -of -way improvements from centerline of street to property line. Permits shall be obtained prior to commencement of any work in the public right -of -way. All work in the public right -of -way shall meet Los Angeles County Public Works standards. 17. Disposal of Construction Waste: No construction activity waster material of any kind, including plaster, cement, paint, mud, or any other type of debris or liquid shall be allowed to be disposed of in the street or gutter, storm drain or sewer system. Failure to comply with this condition will result in charges being filed with the District Attorney. (TCMC 3400- 3411) 18. The applicant shall sign his consent to and acceptance of the conditions set forth above and agrees that such conditions are relevant, material and essential to the variance granted. The applicant further agrees that acceptance of the benefits of this resolution shall bind him to the burdens set forth above. Resolution No. 92- 1655PC Zone Variance 92 -1138 Page 4 • SECTION 4. The Secretary shall certify to the adoption of this Resolution.
