At a Public Hearing on November 10, 2005, the Mayor and Council of the
City of Tybee Island determined that the findings required by the code of
ordinances for the granting of a Variance had been met. Property number 4-
0009 -04 -002 at 5 T.S. Chu Terrace is hereby granted: 2 feet 3 inches
setback variance on the east side for deck.
No other Variances are permitted for this property without further

for new construction. He said that is what the PC approved. Buelterman said he thought it should be
sent back to the Planning Commission as new construction and a variance and then come back to
Council. He so moved, Wolff seconded. Vote was 5, Wolff, Sessions, Buelterman, Crone, and Pearce,
in favor, and 1, Youmans, opposed.
Smith presented a request for a variance for continuance of a non - conforming structure for the addition
of a deck on the east side of an existing structure at 5 T.S Chu Terrace, PIN 4- 0009 -04 -002, Robert and
Paula Crowe, petitioners. Smith said the homeowners association for Pelican Point Condos, next to
this property, said they have no objection. Smith said the east side setback would be 7 ft. 7 in. if this is
approved. Smith said the PC voted to approve. Mrs. Crowe said she is asking for a variance of 2 ft. 3
in. on the east side. She said the house was built in 1948 and takes up most of the lot. Wolff asked if
she was building toward Chu Terrace, and Crowe said no, only going east toward the condos. Crowe
said it would be an open deck. Keith Gay said he was speaking for the condo association and said that
Mrs. Crowe is going toward the parking lot and will have no impact on the residents there. Mayor
Parker asked for a motion. Buelterman motioned for approval, Wolff seconded. Sessions said she
want to say that in the future every other resident of T.S. Chu Terrace would expect the same
consideration. Vote was 5, Wolff, Youmans, Buelterman, Crone, and Pearce, in favor, and 1, Sessions,
opposed.
Smith presented a request for a major subdivision of one parcel into four lots in the R -1 Zone at 16 Van
Horn Avenue, PIN 4- 0003 -09 -030, Soda Properties, LLC, petitioners. Smith said all of the lots would
be at least 12,000 square feet, there is a drainage plan, and a tree survey in the packets. He said the PC
approved this proposal. Keith Gay said there is some question as to the historic significance of the
existing building on this parcel. He said the intent is to relocate this structure to another lot on Tybee.
Gay said they plan to save most of the significant trees and some of the palms would be relocated. He
said the structures would be luxury homes and would blend in very well. Buelterman asked about the
existing structure and its purpose. Gay said he understood it had been the hospital or some part of it. It
is apartments now. Youmans motioned to approve, Buelterman seconded. Vote was unanimous.
Smith presented a request a variance of two feet in the rear setback at 6 Eleventh Place, PIN
4- 0007 -02 -015, Joan Madison, petitioner. Smith said this is located in Tybee Straits. Smith said
Madison was attempting to put in rear stairs and when the footings were being dug, they ran into both
electric and telephone lines. Smith said the PC voted to approve. Wolff motioned to approve,
Sessions seconded. Vote was unanimous.
Smith presented a request for a sketch plan approval for office /retail space at 601 First Street, PIN
4- 0003 -07 -003, GACO Investments, LLC, petitioner. Smith said the PC voted to approve. Keith Gay
told Council that there are three beautiful oaks on this property and is one of his favorite places on the
Island. He said he intends to save all of these oak trees. Gay said the existing building will have to be
removed. He said they plan to locate 80 feet of the building from 16 Van Horn Avenue to this
property. Gay said they would have six feet off of the side and rear, and a deck placed near the large
tree and remain open. He said there will be 17 parking spaces, which is more than required. Gay said
there is not much to change in regards to drainage, and the sewer and water are already there. He said
parking and drive through in the front should be the only changes. Hughes told Council that this is a
sketch plan and they would have to come back for site approval. Buelterman motioned to approve,
Sessions seconded. Vote was unanimous.

A Zoning Variance for Setback at 5 T.S. Chu Terrace was presented by Paula Crowe, petitioner.
The request was for a 6 -foot by 8 -foot deck on the east side of the house, resulting in a 7.7 -foot
side setback rather than 10 feet. Tom Borkowski asked the reason for the variance request.
Crowe said that she understood that the house is nonconforming and she must have a variance.
Borkowski asked if there needed to be a hardship. Crowe said she had scaled back the plans
considerably. Borkowski said that the house is nonconforming to the front and Crowe now wants
to make it nonconforming to the side. Sandy Chandler said the large condominium parking lot
located to the east would mitigate any encroachment. Charlie Brewer, whose wife is vice
president of the Pelican Point Condominium Association, said the association had no problem
with Crowe's plans as long as the oleanders and the palm trees remain. Lawanna Tsoulos made a
motion to approve. Chandler seconded. Voting in favor of the motion were Chandler, Susan Hill,
Gene Kindrick, Brian Renner, and Lawanna Tsoulos. Voting against the motion was Borkowski.
Chairman Dick Smith told Crowe that Council would consider the request November 10, 2005.
Keith Gay presented a Major Subdivision of Land petition for Soda Properties, LLC. The
property is located at 16 Van Horne Avenue and is for four R -1 lots on 1.53 acres. Gay explained
that on the site is the old Fort Screven dispensary, about two - thirds of which will be moved to
another location. He said that at least three parties have requested the relocation of the balance of
the building. Mark Boswell said that the plans call for an update of the whole sewer system for
the City, and that drainage outfall was worked out just prior to the Planning Commission
meeting. Gay said that the tree survey was competed that day and would be given to the city
tomorrow. Lawanna Tsoulos asked Gay if he had talked to Cullen Chambers. Gay responded
yes, briefly. Susan Hill asked if there was a permanent easement of lot 4 to allow access. Gay
responded yes. Gene Kindrick motioned for approval. Lawanna Tsoulos seconded. The vote to
approve was unanimous. Chairman Dick Smith informed the petitioner that City Council would
consider the request at their meeting on November 10, 2005.
Tom Madison presented the next petition. It was a Zoning Variance for Rear Setback request at 6
Eleventh Place. Due to underground telephone and electric lines, the posts for a set of stairs need
to be moved 2 feet. Brian Renner asked if there was an alternative direction to locate the stairs.
Madison explained that because of the limited amount of space there were no alternatives. Dick
Smith commented that this was a duplex with a firewall. Chuck Bargeron said he witnessed the
digging operation and they were doubly lucky. Lawanna Tsoulos motioned for approval of the
request. Gene Kindrick seconded the motion. The vote to approve was unanimous. Chairman
Dick Smith informed Madison that the petition would be before City Council on November 10.
Keith Gay presented a Sketch Plan for 601 First Street on behalf of GACO Investments, LLC.
He explained that this is the site of the Chinese restaurant, and that plans for the site will
compliment the oak trees. He said the plans had called for the Chinese restaurant to remain,
however, the plans have since been reviewed, removing the Chinese restaurant. Two - thirds of the
Fort Screven dispensary building will be relocated from 16 Van Horne Avenue to the 601 First
Street site. Gay said that based on the square footage of the retail space, twelve parking spaces
are required, but the plan has eighteen parking spaces. Gay said the building would set on the
back and the east property lines, have a full circle drive, and use the unopened street for the other
access. Dick Smith asked if the entire area was zoned C -2. Gay replied yes. Smith asked about
parking spaces. Gay replied that Robert Millikan ran the square footages and there would still be
seventeen parking spaces if one needs to be eliminated. Susan Hill asked if the new plan
eliminated the existing restaurant. Gay replied yes. Brian Renner asked the dimensions of the
proposed retail building. Gay said the building was 30 feet by 80 feet; the lot is 110 feet wide

PLANNING COMMISSION MINUTES 06/21/05
Chairman Dick Smith called the June 21, 2005, Tybee Island Planning Commission meeting to
order and declared a quorum. Those members present, in addition to Smith, were Sandy
Chandler, Barry Brown, Susan Hill, Gene Kindrick, Brian Renner, Rachel Perkins, Lawanna
Tsoulos, and Tom Borkowski. City Staff Members Dee Anderson, Chuck Bargeron and Vivian
Woods were also present.
Mr. Kindrick motioned to approve the minutes for May 17, 2005. Mr. Borkowski seconded. The
vote was unanimous.
Mr. Smith presented the petition for Karen Gerow, for a variance of 14.7 feet into front yard
setback to convert an open carport into living space at 1203 6th Avenue. Ms. Gerow was not at
the meeting. Mr. Smith said carports are allowed in the setbacks but living space is not. Mr.
Borkowski motioned to deny. Kindrick seconded. The vote was unanimous. Ms. Perkins said we
do not want to set precedence for closing in carports.
Mike Ward of Stonehenge Home Improvements presented the petition for Robert and Paula
Crowe for a Continuance of a Non - Conforming to add a deck at 5 T S Chu Terrace. Mr. Ward
said they want to come out 8 feet on the front and 14 feet towards Pelican Point. Mr. Brown
asked how far from the property line? Ms. Crowe said this would be the second story and 8 feet
off the ground. Mr. Brown asked why Whitley didn't give dimensions. Ms. Crowe said she did
not know. Ms. Crowe said there is 17 feet from the edge of the house towards the street. We
would like to put an 8 -foot deck across the front of the house on the street. On the side facing
Pelican Point we would like to go out 14 feet. Mr. Ward said the condominium parking lot is on
that side and there is a row of trees there. Ms. Crowe said there would be 5 feet from the edge of
the deck to the property line. Mr. Chandler asked if this would be a two -story deck. Ms. Crowe
said it would be upstairs; downstairs there is a parking garage and two bedrooms that already
exist. Mr. Brown asked if Ms. Crowe knew exactly how far from the property lines that she
would be. Ms. Crowe said if we have 17 feet there now and you give us an 8 -foot variance than
we would be 11 feet from the street. We are 19 feet from that line on the side and we would like
to take 14 feet of that. Mr. Borkowski said it appears from the drawing that the building is 12
feet off of the street and it shows 6 feet for the deck so if you want 8 feet for your deck, you will
be only 4 feet from the street. Mr. Ward said he measured 15 feet from the building to the
pavement. Ms. Perkins said the survey shows considerably less from the building to your lot line.
It looks to be about 10 feet according to the scale at the bottom. Mr. Borkowski asked if it wasn't
already in the setbacks. Mr. Smith said yes, this is a continuation of a non - conforming. Ms.
Crowe said this will be on the second story and I don't think it will interfere with traffic. Mr.
Brown said without actually scaling it off we won't know what is there. Mr. Smith explained that
before making a recommendation to Council the PC has to know exactly what they are
recommending. Mr. Ward apologized and said he would do better next time. After some
discussion between Planning Commissioners, Mr. Brown scaled out the drawing and said they
would be 2 feet off the side yard line for a 12 foot deck as proposed and 4 feet off the front line if

you go for the 6 foot deck. Ms. Crowe told the Commission that they wanted the deck to walk
out and enjoy the ocean views. Mr. Borkowski motioned to deny, Renner seconded. Ms. Perkins
said she is concerned that there are no other decks and all the houses seem to have the same
frontage but she is not as concerned with a side deck. Ms. Hill said she understands Ms. Crowe
wanting an ocean view and the side deck doesn't bother her, however a front deck would put the
house out of line with the other houses on the street. The vote was 7 with Borkowski, Renner,
Chandler, Brown, Hill, Tsoulos, and Kindrick voting to deny, and 1, Perkins, opposed to denial.
Mr. Cannon of 10 Sixth Street presented his petition for a variance of 11 feet into his front yard
setback. Mr. Cannon said they do not have direct access into their house from the front. The only
access is through the garage door. We won't be taking away any of our parking spaces. Ms.
Perkins said you seem to have a generous setback on the side. Mr. Cannon said they did consider
that but were concerned with symmetry. Mr. Cannon said we would not extend further out than
the house to the north. Mr. Brown said having the stairs inside the garage is not uncommon on
this Island. Mr. Brown said he feels there is plenty of room on the side for stairs. Mr. Borkowski
said if the door was located on the side then Mr. Cannon would not have to go in through the
garage doors. Mr. Cannon said he approaches this as a health and safety issue. There was one
situation at a similar house where the EMTs had to struggle to get into the house because it had
no direct access to the street. Mr. Chandler asked if the stairs would come down and branch off.
Mr. Cannon said yes, my proposal is you would come down to a landing and take a 90 degree
turn and on down to the concrete. Mr. Renner asked about the dimensions from the house to the
stairs and from the stairs to the property line. Mr. Cannon said from the house to the foot of the
stairs is approximately 11 feet and 6 inches. The house is set back 20 feet or so. Mr. Renner said
so it would be approximately 9 feet from the foot of the stairs to the property line. Ms. Tsoulos
asked if that was about what his neighbor has? Mr. Cannon said yes. Mr. Brown asked how wide
the steps would be. Mr. Cannon said probably 4 feet. Mr. Brown asked how many stair treads
would there be from the landing to the concrete? Mr. Cannon said probably 3. Mr. Brown asked
if the 11 feet requested would be deep enough for the stairs to reach the landing. Mr. Cannon
said according to his calculations he believes he can fit them in there. Ms. Tsoulos said he would
not be extending closer to the lot line than his neighbor. Ms. Tsoulos motioned to approve. Mr.
Renner seconded. The vote was 5 in favor with Tsoulos, Renner, Perkins, Hill, and Chandler in
favor and 3, Borkowski, Kindrick and Brown opposed.
Mr. Joseph Kinsey, Jr., of 1410 Sixth Avenue presented his petition for a variance of 13.2 feet
into front yard setback and 2.7 feet into side yard setback for porches. Mr. Kinsey said he would
actually be giving back 5 feet of the front yard setback. Mr. Smith said so you have 11.5 on the
side and you want to come out 4 feet. Mr Kinsey said yes. Ms. Tsoulos asked if this was a
recombination. Mr Kinsey said yes. Ms. Perkins asked if the existing porches are solid with
screens? Mr. Kinsey said the existing walls would come out and be replaced with partial walls
with screen. Mr. Smith asked if Mr. Kinsey's son -in -law owned it? Mr. Kinsey said his son -in-
law is trying to buy it. Mr. Renner asked if Mr. Kinsey's house is on the left where the stairs
would go. Mr. Kinsey said yes he is trying to gain a little more room on that porch for the kids to
play. Mr. Smith read a letter from Mayor Parker saying he had no opposition to the request. Ms.
