Wednesday November 4, 2020 at 7 : OOPM
Remote Participation Meeting

2 . Chairman 's comments

At the Board ' s next meeting on November 18, 2020 we will discuss our tobacco regulation if we have a full Board . If
anyone cannot attend or has a conflict please let us know.
In the October 23, 2020 email from Amy von Hone, Health Director to the Board members, she alerted us to a zoom
meeting of the Tobacco Technical Assistance Office from 1 - 3PM on November 18, 2020 to answer any questions
regarding tobacco should you wish to take advantage of that meeting prior to our meeting .
A letter or support from myself for SAPHE 2 .0 to provide more state funds for local Boards of Health was emailed today to
Senator Cyr and Representatives Peake and Whelan .
As there is currently an uptick in Covid - 19 cases in the Commonwealth due to the problem of informal gatherings and
those people not taking precautions which is resulting in increased hospitalizations, Governor Baker has issued a targeted
intervention to reverse the uptick in Covid - 19 cases through Covid - 19 orders 53, 54 and 55 which take effect Friday,
November 6, 2020 .
Covid - 19 Order No . 53 requires all entertainment venues and business to stop at 9 : 30PM daily. Liquor stores must close at
9 : 30PM , but they can continue to provide take out . Stopping services and sales at 9 : 30PM is to allow people to be home
by 10PM .

Covid - 19 Order No . 54 is an Advisory that asks residents to stay at home between the hours of 10PM to 5AM the next day.
In addition, gatherings at private homes are reduced from the current limit of 25 people to a limit of 10 people indoors
and reduced from 50 to 25 people outdoors and those gatherings need to end by 9 : 30PM so that people can be home by
10PM . For outdoor gatherings in Lower Risk Communities where 50 or more attendees are anticipated , the operator of
the venue shall provide notice to the Brewster Board of Health at least one week before the event is scheduled .
Covid - 19 Order No . 55 requires face covering over the mouth and nose for individuals, above the age of 5, when in public
locations regardless of social distancing .
The goal of the latest Covid - 19 Orders is to avoid gatherings with people outside your household . The recent uptick in
Covid - 19 cases is due to primarily social gatherings of young adults . The concern is then the transfer of that infection to
older adults in which the virus has a higher mortality.
The Governor also stressed that schools are not spreaders and should remain open . Students need to be in school .
Enforcement of the Covid - 19 regulations is primarily by our local Health Department and our Municipal Police
Department.

4. J . M . O ' Reilly & Associates, Inc . — Title 5 and local variance requests — 256 Slough Road
John O ' Reilly was present remotely. The following variances are requested :
1 . To allow the SAS to be 5 ' from property line
2 . To allow the SAS to be 18' from cellar wall
3 . To allow the SAS to be 66' from BVW to pond
4 . To allow the SAS to be 95 ' from intermittent stream
5 . To allow the SAS to be 264' from Slough Pond
6 . To allow the SAS to be 173 ' from Pine Pond
Mr. O' Reilly stated that this is an estate owned property and a member of the family is purchasing it . Currently it is a 4
bedroom home on roughly 18, 000sf of land with 2 cesspools . This will be going before Conservation Commission next
week. There are a lot of wetlands on the property so the new system will be installed in the front of the home . The SAS
will be a 37 . 5 ' long by 6' wide . There will be a plastic septic tank installed . They will be relocating the water line to
maintain the 10' required . Groundwater flow is in a Southeast direction and is downgradient from both ponds .
Mrs . von Hone stated that there is no other place on the lot to put this system .

they put on the project.

5 . Consent agenda

The following variances were requested and approved by the Health Director:
1 . To allow the SAS to be 8' from a slab foundation
2 . To allow the SAS to be 7' and 9 ' from property lines
3 . To allow the SAS to be 167 ' from Canoe Pond

6. Discuss language for BOH septic approvals/denials, timeframe for upgrade, approval expiration and
standard and special conditions
Mrs . von Hone pulled together some standard conditions that she took from other towns for the Board .
Mrs . Graczewski asked about the " no addition of bedrooms or floor space" part of the conditions . Mrs . von Hone stated
that "floor space" should only be for commercial building . The rest of the Board agreed that " no addition of bedrooms "
should be only for residential and "floor space" should stay for any commercial property.
Mrs . Graczewski asked about the " garbage grinder" portion and stated that since it is already on the septic plan it wouldn ' t
need to be on the approval as a condition . Mrs . von Hone stated that it is usually listed as a condition but it isn 't
necessary since it is already on the plan . It is an extra level of protection for a buyer if it' s recorded at the Registry of
Deeds .
" Rentals" was questioned by Mrs . Graczewski and how it would be policed . Mrs . von Hone stated that the only time it
would come up would be if there was a complaint.
Mrs . Kampas asked if there was a set list of how many people allowed per home/bedroom . Mrs . von Hone stated that
Title 5 is based on # of bedrooms, not occupants or square footage. It is 2 occupants per bedroom but it is not specified
anywhere else .
Dr. Scherzo stated that if the Town did a registry of rentals, then we could limit the number of occupants .
Mrs . Kampas didn 't think it would be fair to put in a restriction if we don 't actually specify the number of occupants .
Mrs . von Hone stated that we would have to have exact measurements in order to do that and that would be very time
consuming and there is not staff to do that.
Dr. Scherzo stated that this would only come into play if there was a variance request. Mrs . von Hone will take that part
out of the conditions .

Mrs . Graczewski asked about the variances only being good for 1 year and stated that she thought that was a short
amount of time . Dr. Scherzo stated that the thought it was an appropriate time frame in case things have changed they
would come back before the Board . Mrs . Kampas asked about granting of extensions for variances . Dr. Scherzo stated
that he believed that it would have to come back as a new variance request if it expired . Mrs . Graczewski stated that the
Board has extended variances before without them having to come back as a new variance .
Dr. Scherzo stated that the Board should look at changing the time variances are good for and that the wording needs to
be changed to mirror the regulation .
There was talk about year round vs . seasonal use for I/A systems, time frame that the work is required to be done by when
upgrades are needed and a potential start and end date.
Mrs . von Hone stated that usually the whole process takes 6 - 8 weeks but in these times, it could be as long as 3 months .
Mrs . Graczewski thought 60 - 90 days to start would be an acceptable time frame .
Dr. Scherzo asked if it ever happened that a buyer would be responsible for installing a new system . Mrs . von Hone stated
that sometimes it does happen that way.
Mrs . von Hone will have some draft language at the next meeting .
7 . Future meeting topics: wastewater planning update, I/A technology update
Dr. Scherzo told the Board that he was looking for topics to be discussed at future meetings . There was discussion back
and forth about different topics to bring up . Nothing was decided .
