HomeMy Public PortalAboutResolution 92-1673 PC" RESOLUTION NO. 92- 1673PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY AMENDING THE TEMPLE CITY ZONING CODE RELATIVE TO THE REQUIRED FINDINGS FOR GRANTING A ZONE VARIANCE AND CONDITIONAL USE PERMIT. The Planning Commission of the City of Temple City does hereby resolve: SECTION 1. Based upon a public hearing to consider an amendment to the Zoning Code, the Planning Commission finds: 1. That the current findings only address those properties that are immediately next to the subject property and therefore do not sufficiently address the affects upon the surrounding properties. SECTION 2. This project should result in no significant affects upon the environment and a negative declaration has been prepared in accordance with the State CEQA guidelines. The initial statement as prepared indicates that there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 3. The Planning Commission recommends that Section 9201(C) of the Temple City Zoning Code be amended to read as follows: 9201. BURDEN OF PROOF. C. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the adjacent property or neighboring properties; and SECTION 4. The Planning Commission recommends that Section 9203(C) of the Temple City Zoning Code be amended to read as follows: 9203. BURDEN OF PROOF C. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent property or neighboring properties SECTION 5. The Secretary shall certify the adoption of this Resolution.
