RESOLUTION NO. 21-9935
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING THE
CITY MANAGER TO APPROVE A CHANGE ORDER
REQUEST FOR EAC CONSULTING, INC. TO CONDUCT
ADDITIONAL FLOW MEASUREMENTS AT LIFT
STATIONS 4, 5 AND 7 AND CONDUCT AN
ADDITIONAL SMOKE TEST OF THE CITY'S EXISTING
GRAVITY SEWER MAINS, IN AN AMOUNT NOT TO
EXCEED TWENTY-SIX THOUSAND TWENTY-FIVE
DOLLARS ($26,025.00); PROVIDING FOR
INCORPORATION OF RECITALS; PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, pursuant to Resolution #20-9794, the City of Opa-Locka Commission
("City Commission") authorized the City Manager to enter into an agreement with EAC
Consulting, Inc. for continuing professional architectural and engineering consulting
services to perform a Sanitary Sewer Evaluation Survey (Phase III) for Lift Stations 4, 5,
7, and 8, pursuant to RFQ No. 20- 0324200.; and
WHEREAS, EAC Consulting, Inc. conducted field measurements and visual
inspections for the LS 4, 5 and 7 collection basins within the City in November 2020 and
December 2020. Later, Sanitary Sewer Evaluation Survey (SSES) reports were prepared
and submitted to the Miami -Dade Department of Environmental Resources Management
("DERM") in March 2021. All three basins were determined to be out of compliance and
DERM is now requiring that the recommended wastewater collection system repairs be
completed prior to retesting the flow measurements in the wet season, i.e between June
1 and November 30, 2021; and
WHEREAS, EAC Consulting, Inc. is prepared to repeat the flow measurements at
Lift Stations (LS) 4, 5 and 7 once the City indicates that all the system repairs have been
completed. Smoke testing is also required to be performed after the completion of the
repairs to the reported defects/deficiencies. In addition, the Consultant will complete the
scope of services for LS 8 as agreed in the contract agreement dated December 16, 2020
for Sanitary Sewer Evaluation Survey Phase III for LS 4, 5, 7, & 8.
WHEREAS, a change order is necessary and EAC Consulting, Inc. has requested
the Change Order, attached hereto in Exhibit "A". The Change Order includes a repeat
of flow measurements at Lift Stations 4, 5 and 7 and a repeat of smoke testing in the

collection basins for LS 4, 5 and 7. The following activities will be performed under this
task for each of the three collection basins: 1). Smoke Testing. The EAC team will
include a professional vendor for this task. Smoke testing will involve testing the existing
gravity sewer mains using a high -volume blower along with smoke canisters or liquid
smoke to generate the smoke. Smoke will be non-toxic odorless and non -staining; (2)
Night Flow Measurement (3 consecutive nights); (3) Manhole Inspections; (4)
Compilation of Inspection Findings and Reports (Phase Ill Report -Addendum 4); and
WHEREAS, the City Commission finds it is the best interest of the City to approve
the change order.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF OPA-LOCKA, FLORIDA, THAT:
Section 1. Adoption of Representations. The foregoing "Whereas" clauses are
hereby ratified and confirmed as being true and the same are hereby made a specific part
of this Resolution.
Section 2. Approval of Change Order. The City Commission of the City of
Opa-Locka hereby authorizes the City Manager to approve a Change Order for EAC
Consulting, Inc., to include a repeat of flow measurements at Lift Stations (LS) 4, 5 and 7
and repeat of smoke testing in the collection basins for LS 4, 5 and 7, in an amount not to
exceed Twenty -Six Thousand Twenty -Five Dollars, as set forth in Exhibit "A".
Section 3. Effective Date. This Resolution shall be effective immediately upon
adoption hereof and approval by the Governor of the State of Florida or Governor's
designee.

'Staff Summary:
A resolution of the City commission of the City of Opa-locka, Florida, authorizing the city Manager to
Approve a Change Order request for EAC consulting Inc to amend the existing contract for Sanitary
Sewer Evaluation Survey (SSES) Phase III for Lift Station Basins 4, 5, 7, and 8.
Pursuant to Resolution 20-9794, the City Commission of the City of Opa-locka authorized the City
Manger to enter into an agreement with EAC Consulting, Inc for professional architectural and
engineering consulting services to perform a Sanitary Sewer Evaluation Survey (SSES) Phase III for
Lift Station 4, 5, 7, & 8, pursuant to RFQ 20-0324200.
Under the existing agreement for SSES Phase III for PS # 4, 5, 7, & 8, the Consultant conducted field
measurements and visual inspections for Lift Stations (LS) 4, 5, & 7 collection basins in November
and December 2020. Later in March 2021, prepared and submitted the SSES report to Miami Dade
County Department of Environmental Resources Management (DERM). All three basins were
determined to be out of compliance, and DERM is now requiring that the recommended wastewater
collections system repairs be completed prior to retesting the flow measurements in the wet season,
i.e., between June 1 and November 30, 2021.
The amendment will allow the Consultant to repeat the flow measurements and the smoke testing in
the collection basins for LS 4, 5, & 7 once the City indicates that all the system repairs have been
completed. This amendment will also increase the existing project cost by $26,025.00. The Consultant
will also resume its original scope to conduct flow measurements, flow testing, and preparation of
reports for pump station basin 8.

Staff recommends that the City Commission authorize the appropriate City official to amend the
existing contract for SSES Phase III for LS 4, 5, 7, & 8 to allow the Consultant to repeat the flow
measurements, Smoke Testing for LS 4, 5, & 7, resume its original scope for Lift Stations 8, and lastly
prepare the Sanitary Sewer Evaluation Reports that need to be submitted to the Department of
Environmental Resources Management of Miami Dade County.

Dear Mr. Austin,
EAC Consulting Inc. is submitting the following scope and fees to provide Engineering Consulting Services
for Amendment No. 1 of the City of Opa-locka's Sanitary Sewer Evaluation Survey (SSES) Phase III reports
for Lift Stations (LS) 4, 5, and 7.
Our services on this project will be supported by our subconsultant —
• C&I Construction and Design, Inc. - Flow Testing, Smoke test, Manhole inspections and Report
• Grace Professional Solutions, LLC — Project Coordination and Report Preparation
Sanitary Sewer Evaluation Survey (Phase 111)
All sanitary sewer collection and transmission systems are required to complete a Sanitary Sewer Evaluation
Survey (SSES) according to the guidelines published in the U.S EPA's Sewer System Infrastructure Analysis
and Rehabilitation Handbook (1991), EPA/625/6-91/030. The SSES is carried out in three phases. Phase I is
an evaluation of the wastewater collection and transmission system to determine the amount of existing
Infiltration and Inflow. (I/1). Phase II is the plan for upgrading the collection system to meet or exceed the
minimum I/I standards. Phase I I I is the implementation of the plan developed in Phase II and includes
remeasurement to prove that the collection system is operating at an acceptable level with respect to level
of infiltration and inflow (1/1).
The City desires to continue providing reliable wastewater collection services for new development and to
enhance their existing collection system and has requested that EAC perform a Phase I I I SSES which includes
manhole inspections, smoke testing, and three consecutive nights of flow testing to determine compliance
with 5,000 gallons per day -inch -mile (gpdim) standard for I/I as specified in the Miami Dade County Code.
EAC conducted field measurements and visual inspections for the LS 4, 5 and 7 collection basins in
November 2020 and December 2020, and the SSES reports were prepared and submitted to Miami -Dade
DERM in March 2021. All three basins were determined to be out of compliance and DERM is requiring that
the recommended wastewater collection system repairs be completed prior to retesting the flow

PAYMENT TERMS:
Based upon Applications for Payment, submitted to the Owner/Agent by the Contractor, the Owner/Agent shall make progress payments on account of the Contract Sum to
the Contractor as provided below and elsewhere in this Proposal. Therefore, the Owner/Agent shall make payments to the Contractor as follows: Final retentions of the
balance owed are not allowed. Payments due and unpaid under the Contract Documents shall bear interest from the date payment is due at the following rate: any balance
past thirty (30) days will be subject to 1-2% per month (18% per annual) finance charge with the Owner/Agent paying for all attorneys' fees should collection be necessary.
This proposal may be withdrawn by C&I Construction and Design Inc. if not accepted within 30 days.

Grace Professional Solutions, LLC is submitting this price proposal to EAC
Consulting, Inc. to provide Project Coordination for the revisions to the City of Opa-
locka's Sanitary Sewer Evaluation Survey (SSES) Phase III reports for Lift Stations (LS) 4,
5, and 7.
EAC conducted field measurements and visual inspections for the LS 4, 5 and 7 collection
basins in November 2020 and December 2020, and the SSES reports were prepared and
submitted to Miami -Dade DERM in March 2021. All three basins were determined to be

The services in this price proposal include the following:
1. Coordination of C&I Construction and Design (C&I) services
a. Communication with EAC, C&I and the City re the scheduling and coordination
of required work
b. Provide written documentation (via email) of key action items
c. Review outline of investigation report for consistency with Phase III requirements
2. Revisions to the SSES Phase III Report for Basin 4, 5 and 7 based on the inspection findings
reported by C&I and the review comments by DERM.
a. Review submittal from C&I for general sufficiency and alignment with Phase III
requirements.
b. Identify any observations that require corrective action
The following underlying assumptions apply to the scope of GPS services:
1. C&I will conduct the noted field investigation and compile the results and findings into
a written submittal;
2. C&I will conduct its services as a subcontractor to EAC. GPS will facilitate coordination
of services and communication.
3. Night-time flow measurements will be completed before November 30, 2021 and Smoke
testing will be completed before December 2021.
4. Design and implementation of further corrective actions that may be needed are not
included.
5. GPS will prepare a draft report for EAC's use. EAC will provide technical review of the
draft deliverable and approval of the technical content.

THIS AMENDMENT (the "Agreement") is made and entered into this
day of , 2021 between the CITY OF OPA-LOCKA, FLORIDA,
a Florida Municipal Corporation with its principal offices located at 780 Fisherman Street, 4th
Floor. Opa-locka FL. 33054 (the "City"), and EAC Consulting, Inc. (the "Consultant"), a Florida
corporation authorized to conduct business in the State of Florida, with principal offices located
at 5959 Blue Lagoon Drive, Suite 410, Miami, Florida 33124.
WITNESSED:
WHEREAS, on June 10, 2020, the City approved a pool of Qualified Firms to provide
Architectural and Engineering Consulting Services to the City on an as needed basis pursuant
to RFQ# 20-0324200 Library of Miscellaneous Professional Consultants; and
WHEREAS, the Consultant is a member of the pool under the subcategory of Civil
Engineering, Landscape Architectural, Structural Engineering, Traffic Engineering Services,
land surveying, construction testing and inspections, utilities engineering services, and general
consulting engineering services, and has executed a Continuing Services Agreement; and
WHEREAS, the Consultant has entered into an agreement on December 16, 2020 to
provide Engineering Consulting Design Services (known as the "Project", the "Services" or the
"Scope of Services") to provide Sanitary Sewer Evaluation Survey (SSES) Phase III scope and
fees for Lift Station 4, 5, 7, & 8, and the City accepted to compensate the Consultant Forty -
Four Thousand Five Hundred Sixty -Five Dollars and 50/100 ($44,565.50) for the scope
of services specified in the fee proposal dated July 28, 2020, attached hereto as Exhibit "A";
and
WHEREAS, the Consultant has identified some issues that are challenging the original
scope and need immediate action, and therefore on November 24, 2021 the City Commission
adopted Resolution No. to modify the original scope of services and add the additional
fees to repeat the flow measurements at LS 4, 5, & 7 and repeat the smoke testing in the
collection basins 4, 5, & 7, attached hereto as Exhibit "B"
THIS AMENDMENT ONE is considered a continuation part of the Project
Agreement for Design Services between the City of Opa-locka and EAC
Consulting, Inc dated December 16, 2020; and all the terms and conditions of
said agreement that are not modified on this document shall remain the same
and in full effect until the end of the project which is now combined by the original
scope of services, attached hereto as Exhibit "A", and the new scope of services,
attached here to as Exhibit "B".
