TOWN OF FRASER, COLORADO
ORDINANCE NO. ~
AN ORDINANCE CREATING A PLANNING CO~~ISSION FOR THE TOWN OF FRASER,
COLORADO PURSUANT TO THE PROVISIONS OF CHAPTER 31, ARTICLE 23, PART
2, COLORADO REVISED STATUTES, 1973, AS AMENDED.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLO-
RADO:
Section 1. That there is hereby created the Town of Fraser "Planning
Commission" composed of seven (7) members who may perform all functions
currently or hereinafter authorized by the Statutes of the State of
Colorado, this Ordinance, and future Ordinances adopted by the Board
of Trustees of the Town of Fraser, Colorado.
Section 2. The Planning Commission shall consist of four (4) ex officio
members who shall be the Mayor, one (1) of the administrative officials
of the Town selected by the Mayor, a member of the Board of Trustees
selected by the Mayor, and a member of the Board of Trustees selected
by the Board of Trustees. The balance of the Commission shall consist
of three (3) persons appointed by the Mayor.
Section 3. The terms of the ex officio members shall correspond to
their respective official tenure; except that the term of the adminis-
trative official selected by the Mayor shall terminate with the expira-
tion of the term of the Mayor who selected him. The terms of each of
the appointed members shall be six (6) years or until his successor
takes offices; except that the respective terms of one-third (1/3) of
the members first appointed shall be two (2) years, one-third (1/3)
shall be four (4) years, and one-third (1/3) shall be six (6) years.
The Mayor shall determine who shall receive the different initial terms.
Section 4. All members of the Commission shall be bona fide residents
of the Town, and if any member ceases to reside in the Town, his member-
ship on the Commission shall immediately terminate. All members of
the Commission shall serve as such without compensation. The members
appointed by the Mayor shall hold no other municipal office except
that one (1) member may be a member of the Zoning Board of Adjustment
or Appeals.
Section 5. Members, other than the member representing the governing
body, may be removed, after public hearing, by the Mayor for inefficiency,
neglect of duty, or malfeasance in office, and the governing body may
remove the member representing it for the same reasons. The Mayor or
the governing body, as the case may be, shall file a written statement
of reasons for such removal. Vacancies occurring otherwise than through
the expiration of term shall be filled for the remainder of the un-
expired term by the Mayor in the case of the member selected or appointed
by him, and by the Board of Trustees in the case of the member appointed
by it.
Section 6. The Commission shall elect a Chairman from among the members
appointed by the Mayor and create and fill such other of its offices
as it may determine. The term of the Chairman shall be one (1) year
with eligibility for re-election. The Commission shall hold at least
one (1) regular meeting each month and it shall adopt such rules as
it deems appropriate for transaction of business and shall keep a
record of its resolutions, transactions, findings and determinations,
which record shall be a public record.
Section 7. The expenditures of the Commission, exclusive of gifts,
shall be within the amounts appropriated for the purpose by the govern-
ing body, which shall provide the funds, equipment and accommodations
necessary for the Commission's work. After obtaining the approval of
a majority of the Board of Trustees, the Commission may appoint such
employees as it may deem necessary for its work, whose appointment,
promotion, demotion and removal shall be subject to the same pro-
visions of law as govern other corresponding civil employees of the
Town.
Section 8. The Commission may prepare such plans and regulations for
adoption by it and the Board of Trustees of the Town of Fraser as may
now or hereinafter be authorized by the laws of the State of Colorado
or requested by the Board of Trustees of the Town of Fraser and shall
act in an advisory capacity to the Board of Trustees when requested by
the Board or required by the Statutes of the State of Colorado or the
Ordinances of the Town of Fraser.
Section 9. All Ordinances and parts of Ordinances in conflict here-
with, to the extent of such conflict only, shall be and hereby are
repealed.
Section 10. The Board of Trustees hereby declares that an emergency
exists which requires that this Ordinance become effective immediately
upon its adoption, in that substantial development is occurring within
and adjacent to the Town of Fraser which requires careful planning
to protect the health, safety and welfare of the citizens of the Town
of Fraser.
