HomeMy Public PortalAboutResolution 94-1736 PC" " " RESOLUTION NO. 94- 1736PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY RECOMMENDING AN AMENDMENT TO THE TEMPLE CITY ZONING CODE TO ESTABLISH DEFINITIONS RELATIVE TO DAY CARE FACILITIES AND TO ESTABLISH GUIDELINES FOR LARGE FAMILY DAY CARE HOMES IN RESIDENTIAL ZONES. The Planning Commission of the City of Temple City does hereby resolve: SECTION 1. Based upon a public hearing to consider an amendment to the Zoning Code, the Planning Commission finds that: 1. The Zoning Code currently contains outdated requirements for family day care homes in residential zones; and 2. The State of California preempts local governments from the power to regulate large family day care homes except in the areas of noise, traffic, parking and spacing and concentration; and 3. The Zoning Code shall incorporate certain guidelines relative to large family day care homes in order to prevent potential enforcement problems and adverse impacts; and 4. The use of a single family residence as a small family day care home shall be considered a residential use of property for the purposes of all local ordinances. SECTION 2. This project should result in no significant affects upon the environment and a negative declaration has been prepared in accordance with the State CEQA guidelines. The initial statement as prepared indicates that there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. SECTION 3. The Planning Commission recommends that Sections 9113 and 9115 of the Temple City Zoning Code be amended to read as follows: 9113. 'D' SECTION. Day Care Center shall mean any child care facility other than a family day care home, and includes infant centers, preschools, and extended day care facilities. 9115. 'F' SECTION. Family Day Care Home shall mean a home which regularly Resolution No. 94- 1736PC Page 2 provides care, protection, and supervision of 12 or fewer children, in the provider's home, for periods of less than 24 hours per day, while the parents or guardians are away, and includes the following: 1. Large Family Day Care Home shall mean a home which provides family day care for 7 to 12 children, inclusive, including children under the age of 10 years who reside at home, as defined in regulations issued by the State of California. 2. Small Family Day Care Home shall mean a home which provides family day care for six or fewer children, including children under the age of 10 years who reside at home, as defined in regulations issued by the State of California. SECTION 4. The Planning Commission recommends that Section 9202 of the Temple City Zoning Code be amended to read as follows: 9202. CONDITIONAL USE PERMITS. WHEN REQUIRED. Day Care Centers, Including All R Zones. SECTION 5. The Planning Commission recommends that Section 9331.B.7., Section 9350.B.7. and Section 9360.E of the Temple City Zoning Code be amended as follows: 7. Child Day Carc, for net to cxeccd thrcc (3) children. 7. Small Family Day Care Home. 8. Large Family Day Care Home, subject to guidelines as contained in Section 9458. SECTION 6. The Planning Commission recommends that Section 9458 be added to the Temple City Zoning Code as follows: CHAPTER 1 - ZONING CODE PART XIX - SPECIAL USES 9458. LARGE FAMILY DAY CARE HOMES. A. A large family day care home shall mean a home which provides family day care to 7 to 12 children, • • " " Resolution No. 94- 1736PC Page 3 inclusive, including children under the age of 10 years who reside at the home, as defined in regulations issued by the State of California. B. At least ten (101 days prior to the date on which the Community Development Director will make a decision on an application to operate a large family day care home, a notice of the proposed use shall be mailed to all owners shown on the last equalized assessment roll as owning real property within a 100 -foot radius of the exterior boundaries of the proposed large family day care home. C. No hearing shall be held before a decision is made on the application unless a hearing is requested by the applicant or other affected person. D. The Community Development Director shall grant a permit for a large family day care home as an accessory residential use if the provider of the family day care home complies with the following standards: 1. The facility shall be the principal residence of the provider and the use is clearly incidental and secondary to the use of the property for single family residential purposes. 2. No structural changes or alterations are proposed which will alter the character or appearance of the single- family residence. 3. No more than one large family day care home shall be permitted within 300 feet of an existing large family day care home. 4. One off- street parking space for each employee shall be provided, excluding the code required parking for the dwelling. The residential driveway is acceptable, if the parking space will not conflict with any required child drop- off /pick -up area and does not block the public sidewalk or right -of -way. 5. Large family day care homes located on a major arterial street shall provide drop- off /pick -up area designed to prevent vehicles from backing onto the major arterial roadway. Resolution No. 94- 1736PC Page 4 6. The use shall comply with the noise ordinance requirements as contained in the Temple City Zoning Code. In order to mitigate noise impacts on adjoining residential properties, no play area shall be permitted in the front yard area or within 15 feet of an adjoining or adjacent residence. 7. A license shall be obtained for such use from the State of California. 8. The use shall comply with all State Fire Marshal requirements for building and safety which apply to large family day care homes, and with all local building and fire codes which apply to single family residences. E. The applicant or other affected person may appeal the decision rendered by the Community Development Director on the proposed use to the Planning Commission by submitting an application or letter of appeal within 10 days of the decision. The decision of the Planning Commission shall be final and conclusive if not appealed to the City Council within 10 days of the Commission's decision. The appellant shall pay all applicable costs of an appeal. F. Upon appeal the Planning Commission or the City_ Council may approve, approve with conditions, or deny a permit for a large family daycare home based upon reasonable considerations and findings relative to spacing and concentration, traffic control, parking, noise or failure to comply with applicable State Fire Marshall standards as referenced in the State of California Health and Safety Code. SECTION 6.
