HomeMy Public PortalAbout388CITY OF MEDINA ORDINANCE NO.388 AN ORDINANCE ESTABLISHING A STORM SEWER IMPROVEMENT TAX DISTRICT THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA ORDAINS AS FOLLOWS: Section I. Background: Findings. 1.01. The City is authorized by Minnesota Statutes, Sections 444.16 — /111.21 (the "Act') to establish a storm sewer improvement tax district (the "District') to acquire, construct, reconstruct, extend, maintain and otherwise improve storm sewer systems and related facilities within the District in accordance with the Act, and to finance such activities by ad valorem taxes levied on property within the District. 1.02. It is found and determined that it is in the best financial interests of Medina and its storm water management program that the District be established. The District shall be comprised of the land within Medina legally described as follows: That part of the South Half of the Northeast Quarter of Section 28, Township 118, Range 23, described as follows: Commencing at the southeast corner of said South Half; thence north along the east line thereof to the south line of the plat of MEDINA MORNINGSIDE; thence westerly along the south line of said plat to the southeast corner of Lot 1, Block 4 of said plat; thence southerly, along the extension of the east line of said Lot 1 a distance of 71.13 feet; thence westerly to the southeast corner of Lot 1, Block 4, of said plat; thence continuing along the southerly line of said Block 4 to the southwest corner of Lot 8, said Block 4; thence northerly along the west line of said Lot 8 a distance of 85.08 feet; thence northwesterly parallel with the southwesterly line of Lot 9, said Block 4 to its intersection with the northwesterly line of said lot 9 extended; thence northeasterly along said extended line to the southwest corner of said Lot 9; thence northwesterly to the southwest corner of Lot 1, Block 4, MEDINA MORNINGSIDE FIRST ADDITION; thence southwesterly to the most southerly corner of Lot 2, Block 4, MEDINA MORNINGSIDE FIRST ADDITION; thence southerly parallel with and 651.4 feet east from the west line of the Southwest Quarter of the Northeast Quarter of said Section 28, to the south line thereof; thence easterly to the point of beginning. Section II. Establishment: Authorizations. 2.01. The Keller Estates Storm Sewer Improvement Tax District is established. The city shall have all powers and authority conferred by the Act in the operation of the District. Ordinance No. 388 July 5, 2005 2.02. The boundaries of the District are as described above. 2.03. The Administrator -Clerk -Treasurer is authorized and directed to file a certified copy of the ordinance with the Auditor and Recorder of Hennepin County. Section III. This ordinance shall become effective upon its adoption and publication. Adopted by the City Council of the City of Medina this 5th day of July, 2005. ruce D. Workman, Mayor Attest: Chad M.
