HomeMy Public PortalAboutCHAP 118 Railroads.pdf CHAPTER 118: RAILROADS SECTION 118.01 Speed of Trains 118.02 Bumpers on Side Tracks 118.03 Obstructing Streets 118.04 Lights on Engines 118.05 Riding on Cars 118.06 Maintenance of Crossings 118.07 Crossing Signals 118.08 Flagman or Gates 118.09 Operating Train on Unprotected Crossings 118.01 SPEED OF TRAINS (a) No person or corporation shall permit or cause any locomotive engine, car or train of cars, to pass along or on any unprotected grade level railroad crossing of any city street within the City at a greater rate of speed than 40 m.p.h. For purposes of this section, an unprotected grade level railroad crossing shall be one that crosses a city street at grade level which does not have an operating automatic train activated warning signal with crossgates or signalmen. (b) It shall be the duty of any pedestrian or operator of any motor vehicle, bus, car, truck, bicycle, or motor bike to stop prior to crossing a railroad, to look both ways and then proceed only with caution when the way is clear. (c) It shall be unlawful for any unauthorized person to walk along any railroad right-of-way within the City if Richmond unless permission is granted from the operating railroad. (d) Each railroad that operates within the City of Richmond shall permit the City Engineer or his or her designee to conduct periodic inspections of the railroad lines and crossings within the City of Richmond to insure that the lines meet federal and State safety standards. The duty is upon the railroad pursuant to Indiana Code I.C. 8-6 to maintain its railroad lines and crossings. (‘72 Code, 38.01) (Ord. 1479-1953; Ord. 126-1985) 118.02 BUMPERS ON SIDE TRACKS It shall be unlawful for any person or corporation to keep or maintain within the City any railroad switch with the terminus thereof abutting on or against any street, alley, sidewalk, or property of another without a suitable bumper or some other safe and suitable structure at the terminus, so as to prevent any car or engine running off onto the street, sidewalk alley, or property. (‘(‘72 Code, 38.02) (Ord. 218-1910) 118.03 OBSTRUCTING STREETS It shall be unlawful for any railroad company, agent, employee, or other person to leave any locomotive engine, car, or train of cars on or across any street or sidewalk within the City longer than reasonably necessary, or for a longer time than ten minutes, unless from some unavoidable accident it cannot be removed within that space of time. Nor shall any company, agent, employee, or other person use any railroad track, side track, or switch within the City, where it crosses any street, sidewalk, or alley, by running locomotives, engines, cars, or train of cars, backward or otherwise so as to unreasonably obstruct the travel of persons or vehicles on the street, sidewalk, or alley. (Ordained 10-6-1879) 118.04 LIGHTS ON ENGINES On every locomotive engine, railroad car, or train of cars, running in the nighttime on any railroad track in the City, there shall be kept while so running a brilliant and conspicuous light on the forward end of the locomotive engine or train of cars. If any engine, car, or train is run backward the light or a proper guard shall be kept at the rear end thereof. (‘72 Code, 38.05) (Ordained 10-6-1879) 118.05 RIDING ON CARS No unauthorized person shall ride on, or attempt to ride on, or to get on or off of any railroad engine, tender, train, or car, or any part thereof, while standing on any railroad tracks or in motion within the limits of the City or be on any part of the railroad yard between Ninth Street and a line crossing the yard from north to south at the east end of the passenger depot. (‘72 Code, 38.07) (Ordained 10-6-1879) 118.06 MAINTENANCE OF CROSSINGS It shall be the duty of railroad companies to grade and plank or pave the street, alley, and sidewalk where their tracks cross any street, alley, or sidewalk. The crossings shall be built and maintained as directed by the City Engineer. (‘72 Code, 38.08) (Ordained 10-6-1879) 118.07 CROSSING SIGNALS All railroad companies whose track or tracks cross South Sixth Street, South H Street, South J Street, South L Street, South N Street, South 0 Street, or Northwest Fifth Street in the City shall at each crossing maintain at all times in good working order at their own expense a reliable and substantial standard flasher light signal system of approved type, subject to the rules of the State Highway Commission, and operated electrically as trains approach the crossing so as to warn persons approaching or about to cross the tracks at the crossing of the approach of a locomotive engine, car, or train of cars or other impending danger in connection with the running of trains. In place of the flasher light signal at North Second Street, there may be maintained a reliable bell signal such as is in general use by railroads. (‘72 Code, 38.09) (Ord. 856-1926; Ord. 1223-1941) 118.08 FLAGMAN OR GATES All railroad companies, whose tracks cross Northwest Fifth Street, North Sixth Street, North Eighth Street, Fort Wayne Avenue, North Twelfth Street, North Thirteenth Street, North Fifteenth Street, and Williamsburg Pike in the City shall at each of the crossings maintain, at their own expense and at all times while any locomotive engine, car, or train of cars are being run or are liable to run over or across any of the crossings, a flagman whose duty it shall be to warn persons approaching or about to cross the tracks at any of the crossings of the approach of any locomotive engine, car, or train of cars, or other impending danger connected with the running of trains. In place of a flagman, the railroad companies may maintain proper and sufficient gates at any crossing which shall be so operated as to warn persons of any approaching locomotive, engine, car, or train of cars. (‘72 Code, 38.10) (Ord. 1372-1949; Ord. 13105-1949) 118.09 OPERATING TRAIN ON UNPROTECTED CROSSINGS Any engineer, conductor, or other person in the employ of any railroad company shall not run any engine or train of cars across any crossing which is not protected with a flagman, gates, or signals as required by this chapter.
