ORDINANCE NO.389
An Ordinance Amending Section 315.09 of the Code of Ordinances
Regarding Lawful Gambling Licenses
The city council of the city of Medina ordains as follows:
SECTION I. The Medina code of ordinances is amended by deleting the stfielcen material
and adding the underlined material as follows:
315.09 Conditions Governing Approval. The following conditions shall govern approval
by the City of applications for premises permits and bingo hall licenses:
Subd. 1. Approval shall be granted only if the applicant and all of its owners,
managers, employees, agents or interested parties are free of convictions for offenses which
relate directly to such person's ability, capacity or fitness to perform the duties and
discharge the responsibilities of the activity;
Subd. 2. No approval shall be granted to an applicant which has, within one year
prior to the day of the application, been denied licensure by the board or approval by the
City, had a permit or approval regarding lawful gambling revoked, canceled or suspended or
whose owners, managers, or interested parties have had a license, permit or approval
similarly denied, revoked or suspended;
Subd. 3. Approval shall be granted only to applicants who have fully and truthfully
answered all of the information requested in the application, who have paid all fees and have
cooperate fully and truthfully with the City in the review of the application;
Subd. 4. Approval shall be issued only to fraternal, religious, veterans or other
nonprofit organizations which have been in existence for at least three years prior to the time
of application and have at least 15 active members who are residents of the City's trade area;
Subd. 5. Approval shall not be granted if the granting of such approval would be
inconsistent with the comprehensive development plans of the City, or would otherwise
have a detrimental effect upon other persons or properties in the vicinity; and
Subd. 6. The Applicant must pay an annual fee to the City of $100; and
Subd. 7. The chief of police or designee has authority to conduct a criminal history
and driver's license check on the applicant and all of its owners, managers, employees,
agents or interested parties, through the State of Minnesota, Bureau of Criminal
Apprehension. Failure by the applicant or any of its owners, managers, employees, agents
or interested parties, to consent to the background check will result in denial of the license.

SECTION II. This ordinance shall be effective upon its adoption and publication.
Adopted by the city council of the City of Medina this 16t}' day of August,
2005.
