Home My Public Portal AboutAddendum No. 1 to Contract No. 187-2018...cavating - Demo of four properties:= ADDENDUM THIS ADDENDUM, (Number I to Contract No. 187-2018) is made and entered into this 4 day of 20I8, by and between Richmond, Indiana, a municipal corporation acting through its Board of Public Works and Safety with its office at 50 North 51' Street, Richmond, Indiana, 47374 (hereinafter referred to as "City"), and Mikesell Excavating, 652 New Carden Road, New Paris, Ohio, 45347 (hereinafter referred to as "Contractor"). WHEREAS, City and Contractor entered into Contract No. 187-2018 on November 29, 2018, which Agreement retains Contractor to perform demolition and restoration services in connection with the demolition and removal of certain unsafe structures located in Richmond, Indiana, for the Blight Elimination Program; and WHEREAS, The Parties wish to amend said Agreement to allow Contractor to perform additional services including, but not limited to, asbestos removal that exists at the structures as set forth within said Agreement. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained, including the above stated- recitals, City and Contractor hereby agree as follows: 1. The City and Contractor executed and entered into Contract No. 187-2018, on November 29, 2018, which Agreement is incorporated herein by reference. Pursuant to Contract No. 187-2018, Section XIII (Miscellaneous), the Parties may alter or amend the Agreement in whole or in part at any time by filing with the Agreement a written instrument setting forth such changes signed by both Parties. 2. The parties have agreed that Contractor, by and through its chosen subcontractor, shall perform additional services including, but not limited to the removal and proper P g disposal of asbestos that exists at the locations set forth in Contract No. 187-,2018, as more specifically set forth on the attached Exhibit A., which additional services shall be performed in a manner consistent with Contract No. 187-2018. The agreed cost increase for said services is as set forth on the proposals dated December 13-14, 2018, which proposal sheets are attached hereto and incorporated herein by reference as Exhibit A. Contractor agrees to abide by the same. The payment made to Contractor for said additional services shall be increased by a sum not to exceed the amount of Four Thousand Four Hundred Dollars a is ($4,400.00), resulting in a new total Compensation sum not to exceed the total amoun of Thirty-seven Thousand Three Hundred Dollars and Zero Cents ($37,300). The remainder of the terms and conditions set forth in the Agreement sh6'11 remain unaltered and shall continue to apply. 3. City and Contractor expressly agree that all other terms, conditions, and covenants contained in Contract No. 187-2018, shall be applicable to this Addendum, unless such term, condition or covenant conflicts with this Addendum Number 1, in which case this Addendum Number 1 shall be controlling. Both Parties hereby agrees ghat with the exception of the additional services for the removal and proper disposal of asbestos at the locations set forth in said Agreement, and the corresponding increase to the Compensation under the Agreement, Contract �. -- No.187--2018 shall remain intact and unchanged and in full force and effect. 5. Both Parties agree that any person executing this Contract in a representative capacity hereby warrants that he or she has been duly authorized by his or her principal to execute this Addendum.
