THIS SUPPLEMENTAL AGREEMENT,, made and entered into this J:A6 day of
2019, by and between. RUNDELL ERNSTBERGER .ASSOCIATES, INC, Indianapolis, Indiana, 14reinafter
referred- to as the "CONSULTANT", and the City of Richmond, IN, hereinafter- referred to as the "LOCAL
PUBLIC AGENCY" or ""LPA"
WITNESSETH

WHEREAS, on December 22nd, 2016, the LPA entered into a Contract with the CONSULTANT for
services required for Construction Engineering Services for the construction of the Richmond Stellar Streets
Project, Richmond,'Indiana, INDOT Project Des. No. 138281.0, herein after referred to as the Contract, and
WHEREAS, on April I V1, 2019) the LPA and the CONSULTANT agreed to amend the Contract with
Contract Supplement No.' 1, and
WHEREAS, the LPA and the CONSULTANT have determined that an additional amendment to the
the ' Contract is necessary due to an extension of the project construction schedule.
Now, THEREFORE, the parties agree that the Contract shall be modified by this Contract
Supplement -No. 2 in accordance with the following:
I. SECTION III of the Contract shall be modified as follows:
"SECTION III TERMS. The term of this Contract, shall be from the date of the last signature
affixed to this Contract to the completion of the construction contract which is estimated to be 97 weeks.
A schedule for completion of the Services and deliverables is set forth in Appendix "C" which is herein
attached to and made an integral part of this Contract.
II. SECTION IV of the Contract shall be modified as follows:
"SECTION IV COMPENSATION. The LPA shall :pay the CONSULTANT for the Services
performed under this Contract as set forth in Appendix "D" which herein attached to and made an
integral part of this Contract.. The maximum amount payable under this Contract shall not exceed
$7504923.81."
III. Appendix C of the Contract shall be modified as follows:
Appendix C, . paragraph 4, shall be MODIFIED to read.-
"The Inspection budget was based�n the following project scheduler
INDOT Contract Letting Date of October 12, 2017.
Notice. to Proceed on December 4, 2017
Start of construction onor after February 22, 2018.
Substantial Completion date of August 3 0, 2019
Should these schedule dates be reduced or increased or additional man-hours be required, the contract
shall be modified- accordingly."
IV. Appendix -D of the Contract shall be modified as follows:.

Appendix D, Section A, paragraph 1, shall be .MODIFIED to read:
"The CONSULTANT shall receive as payment for the work performed under this Contract the total
amount not to exceed $750,923.81, unless a supplement is executed by the parties which increases the
maximum amount payable."
