ORDINANCE NO.391
AN ORDINANCE ESTABLISHING A STORM
SEWER IMPROVEMENT TAX DISTRICT
THE CITY COUNCIL OF THE CITY OF MEDINA, MINNESOTA ORDAINS AS
FOLLOWS:
Section I. Background: Findings.
1.01. The City is authorized by Minnesota Statutes, Sections 444.16 — 444.21 (the "Act") to
establish a storm sewer improvement tax district (the "District") to acquire, construct, reconstruct,
extend, maintain and otherwise improve storm sewer systems and related facilities within the
District in accordance with the Act, and to finance such activities by ad valorem taxes levied on
property within the District.
1.02. It is found and determined that it is in the best financial interests of Medina and its
storm water management program that the District be established. The District shall be comprised
of the land within Medina legally described as follows:
Lots 1, 2, 3, and 4, Block 1, Medina Clydesdale Marketplace;
Lots 1 and 2, Block 2, Medina Clydesdale Marketplace;
Lots 1 and 2, Block 3, Medina Clydesdale Marketplace;
Outlots A, B, C, D and F, Medina Clydesdale Marketplace;
Lot 1, Block 1, Cates Medina Addition;
Lot 1, Block 1, Francis Addition;
Lot 1, Block 2, Francis Addition;
Lot 1, Block 1, West Ridge Development.
Section II. Establishment: Authorizations.
2.01. The Medina Clydesdale Marketplace Storm Sewer Improvement Tax District is
established. The city shall have all powers and authority conferred by the Act in the operation of
the District.
2.02. The boundaries of the District are as described above.
2.03. The Administrator -Clerk -Treasurer is authorized and directed to file a certified copy
of the ordinance with the Auditor and the Recorder of Hennepin County.
Section III. This ordinance shall become effective upon its adoption and publication.
Adopted by the City Council of the City of Medina this 6th day of September, 2005.
