HomeMy Public PortalAboutZBAM 2003-01-01 FRASER ZO1~~~G**BOARD+ cOF ADJUSTMENT a1Li1` V 1 DATE: Wednesday, June 11, 2003 PLACE: Town Hall Board Room PRESENT Board: Chairperson Debbie Knutson and Members: Rusty Boudreaux, Karen Frye and Steve Sumrall Staff: Community Development Director Jeff Durbin, Planner Drew Nelson and Town Clerk Molly McCandless Others: Dean Cinocco Chair Knutson called the meeting to order at 6:30 p.m. Avvroval of Miautes from the Jaauarv 30. 2002 meeting Ms. Frye moved, and Mr. Sumrall seconded the motion to approve the minutes of the January 30, 2002 meeting, amending the Action Item to reflect the action taken. Motion carried: 4-0 Oven Forum Chair Knutson asked for items not on the agenda. The Town is in need of an additional ZBA member and a Planning Commissioner. Any suggestions should be directed to Mayor Dennis Soles. Hearing nothing further for Open Forum, the Chairperson moved on to the next item. Action Items Public Hearing -Whispering Pines I Minor Subdivision rear-yard setback variance request Mr. Sumrall moved, and Ms. Frye seconded the motioa to open the Public Hearing. Motion carried: 4-0. Chair Knutson stated that the packet materials were extremely well organized. The members concurred. There was no public comment. Following some review and questions, Mr. Sumrall moved, and Ms. Frye seconded the motion to close the Public Hearing. Ms. Frye moved, and Mr. Sumrall seconded the motioa to make the following findings: (a) That satisfactory proof has been provided showing that the proposed situation of a requested setback variance is reasonably necessary for the convenience and welfare of the public; ýÿ Board of Adjustment Minutes 06 / 11 / 03 Page 2 (b) That the requested setback variance would not authorize any use other than a use enumerated as a use by right of the district; (c) That an unnecessary hardship to the owner would be shown to occur if the provisions of the Ordinance were literally followed; (d) That the circumstances found to constitute a hardship were not created by the owner; (e) That the variance would not injure the value, use of, or prevent the proper access of lighted air to the adjacent properties; and (fl That the variance would not be out of harmony with the intent and purpose of the Zoning Ordinance. and therefore approve the request for a variance to allow a six foot rear setback on Lots MH-68 and MH-69 of the Whispering Fines I Minor Subdivision.
