HomeMy Public PortalAboutZBAP 1999-09-16• BOARD OF ADJUSTMENT SEPT. 16, 1999 The Board of Adjustment was called to order at 6:30 p.m. Board present were Chairman Knutson, Boudreaux, Coulson, and Sumrall. Staff present were Winter and Reid. MANLY VARIANCE REQUEST The Manly's are seeking a variance from the requirement in the zoning allowing structures only under one roof. Manly would like to build an apartment over an existing detached garage. He believes that it will be affordable housing. Entered into the record was the proof of Publication regarding the variance request. Entered into the record were the certified return receipts of the hearing notice to property owners with 200' of the property requesting the variance. Mr. Manly discussed the request with the Board and answered questions regarding the proposal. The Town Clerk discussed that Mr. Manly would need to address with Public Service any concerns they might have regarding the gas line easement on his property in relation to building. Manly was also advised that any covenants that maybe placed on the • property are not a concern of any decision from this Board. Knutson also advised that the garage structure should be looked at for soundness. Sumrall made a motion to grant the variance finding that the request: (a) Satisfactory proof has been presented that the request is necessary for the convenience of the public. (b) The request is a use by right. (c) A hardship would occur if the request was not granted as housing is necessary to the community. (d) The housing needs were not created by the owner. (e) The variance does not injure the value, use of or proper access of light to the adjacent properties. (f) The variance is not out of harmony with the purpose of the Ordinance. Motion 2nd by Boudreaux, carried, all present voting aye. Variance granted. ýÿ • C.B. JENSEN AND A.J. JENSEN LOT LINE VARIANCE The Jensen variance request is for a lot line variance. The are proposing to build garages on separate lots but would like to join them, under one roof, at a party wall on the lot line. This would create one structure, and be visually more appealing that 2 separate buildings. A party wall agreement will facilitate separate ownership. Entered for the record is the proof of publication for the variance hearing. Entered for the record is the return receipts certificates of mailing the hearing notice to the property owners within 200 feet. Jensen answered questions regarding the request. Coulson made a motion to grant the variance finding the following: (a) Satisfactory proof has been presented that the request is reasonably necessary for the welfare of the public. (b) The request is a use by right. (c) A hardship would occur to the owner if the request were not granted. (d) The variance will not injure value, light or proper access of adjacent properties. (e) The request would not be out of harmony with the intent of the Ordinance. • (f) The hardship was not created by the owner. Coulson also added that a plat note be placed on the proposed lot line correction plat that states the ~arage exterior appearance will always remain to look like a single structure. Motion 2n by Sumrall, carried, all present voting aye. Variance granted. No further business, meeting adjourned. •
