TOWN OF ERASER
JANUARY 19, 2000
The Board of Adjustments was called to order at 6:30 p.m. Board present were Rusty
Boudreaux, Karen Frye, Motor Coulson, Tim Kinney and Steve Sumrall. Staff present
were Reid and Winter.
Coulson was appointed the Chairperson.
PUBLIC HEARING
PINE TREE PLAZA, TRACTS Al AND Bl, HEIGHT VARIANCE
Chas McConnell has requested a height variance from 35 feet to 55 feet.
The record for the Public Hearing is set by Proof of Publication of the hearing for the
height variance and the Proof of certified mailing to property owners within 100 feet
regarding the hearing.
Applicant is seeking the height variance as ,the subject.prQperty is adjacent to Pine Tree
Plaza in Winter Park and the building is at a height of 55 feet. The surrounding property
• belonging to Maryvale has some areas allowing up to 75 feet.
The Town Board reviewed the request at the last meeting and recommends that the height
variance be granted on this request.
After lengthy discussion, Frye made a motion to grant the variance and allow the height
of 55 feet, Board finding the following:
(a) Satisfactory proof has been presented that the request is reasonable necessary
for convenience of the public.
(b) The request is a use by right. - -
(c) A hardship would occur to the owner if the request were not granted.
(d) The variance will not injure value, use or proper light access of adjacent
properties.
(e) The request would not be out of harmony with the intent of the Ordinance.
(f) That the circumstances were not created by the owner.
Motion 2nd by Kinney. Motion carried by a unanimous vote.
Discussion was held with regard to a variance needed for parking. McConnell gave a
chart of the Fraser requirements versus the Town of Winter Park requirements. Variance
needed would be fi„r.. 57 spaces required by Fraser regulation to -----------. Board
discussed this at length.

• Upon review Kinney made a motion to approve the variance finding the following:

WESTERN STEEL ][NCo, GEORGE SWlr'Y~, HEIGHT VARIANCE
George Swift, purchaser of the Arby's property is proposing a Hotel at that location.
The height request would allow a pitched roof system which is a more architecturally
pleasing design. This would require a 7 foot variance. Also a design was presented
showing a higher portion of roof, used only as an architectural feature, resulting in that
portion if approved at a height of 48 feet 10 inches.
• The record was set with the Proof of Publication and the copies of certified mailings to
property owners within 100 feet.
Swift presented the request and had drawings for review.
Katrina Larson had concerns about granting the height variance and commented on the
proposed design..
Lisa Ashbaugh, property owner near the requested property was concerned about the
height affecting her property. Swift will meet with Ashbaugh.
The Town Board reviewed the request-and recommends approval of a variance not to
exceed 42 feet at 3 stories.
After further discussion Kinney made a motion to continue the hearing until Jan. 26~" at
6:30 p.m. , 2°d Sumrall, carried.
No further business, meeting adjourned at 8:30 p.m.
