ORDINANCE NO.30-2019
A GENERAL ORDINANCE AMMENDING
CHAPTER 154: UNIFIED DEVELOPMENT ORDINANCE
WHEREAS, Chapter 153: Subdivision Control Ordinance and Chapter 154: Zoning code, containing
original and amended provisions regarding subdivisions and zoning dating back to July 2,
1984 and June 3, 1958 were replaced with Chapter 154: Unified Development Ordinance
as set forth in Ordinance No. 10-2010; and
WHEREAS, The City of Richmond is authorized by the State of Indiana to amend the Unified
Development Ordinance, as set forth in Indiana Code 36-74-607 et seq.; and
WHEREAS, Common Council, pursuant to Indiana Code 3 6--7-4--607, conducted a public hearing on
said petition on 2019, after publishing legal notice
thereof at least 10 days in advance of said hearing as required by statute; and
WHEREAS, The Richmond Advisory Plan Commission, has considered a proposal to amend the
Unified Development Ordinance, pursuant to Indiana Code 36-74-607, conducted a
public hearing on said petition on 2019, after publishing
legal notice thereof at least 10 days in advance of said hearings as required by ordinance;
-and
WHEREAS, It is in the best interest of the City to amend the Unified Development Ordinance in order
to promote public health, safety and welfare and in order to provide for the desirable
future development of the community; and
WHEREAS, It is in the best interest of the City to establish reasonable standards of design and
procedure for subdividing land for residential, institutional, commercial, and industrial
purposes in order to promote public health, safety and welfare and in order to provide for
the desirable future development of the community; and
WHEREAS, It is in the best interest of the City to classify, regulate, and restrict the location, bulk and
height of buildings and structures and the premises to be used for trade, industry,
residence or other specific uses, in order to .promote _public health, safety and welfare and
in order to provide for desirable future development of the community, all of which is in
accordance with the City of Richmond Comprehensive Plan; and
Wf EREAS, It is in the best interest of the City to provide a method of administration and to prescribe
penalties for the violation of provisions outlined in order to ensure that the goals of the
public health, safety and welfare and the goals of desirable future development of the
-community are reached; and

WHEREAS, Specifically, the City wishes to amend the UDO to prohibit the parking of large
commercial motor vehicles within all residentially -zoned district; and
WHEREAS, It is in the best interest of the City to adopt the proposal of the Plan Commission, which
proposal was certified by the Advisory Plan Commission on , 2019
and was on file with the Department of Metropolitan Development for at least 10 days
after Certification pursuant to Indiana Code 36-7-4-607
NOW, THEREFORE, be it ordained by the Common Council of the City of Richmond, Indiana, that
Section 5.61, Section 5.62, Section 5.63, and Section 5.64 of said Chapter 154 Unified Development
Ordinance shall be amended as follows:
5.61 PK-02: Single-family Residential Parking Standards
This Parking Standards section applies to the following zoning districts:
Low Density Single -Family Residential (R1) District;
Medium Density Single -Family Residential (R2) District; and
High Density Single -Family Residential (R3) District.
The following standards apply:
A. Quantity: A minimum of three (3) off-street parking spaces shall be required -per dwelling
unit.
B. Minimum Garage: A one -car garage shall be required for all single-family residences.
C. Location
1. Same Lot- The required parking spaces shall be located on the same lot as the
dwelling unit.
2. Garages: The required parking spaces may include spaces within garages and/or
carports.
D. Prohibited: Parking of large commercial motor vehicles such as semi -truck cabs, semi -
truck trailers, semi -truck tractors, or any f the same combined and having an overall
length of more than twelve (12) feet, and uses having an overall length of more than
twelve (12) feet, and the like, shall not be permitted. This prohibition shall not apply to
the temporary parking of large commercial motor vehicles actively in use by any
contractors engaged in construction or rehabilitation projects at a residential location.
5.62 PK-03: Traditional Residential Parking Standards
This Parking Standards section applies to the following zoning district:
Urban Residential (UR) District
The following standards apply:
A. Quanti = A minimum of two (2) off-street parking spaces shall be required per dwelling
unit.
B. Location:
1. Same Lot. The required parking spaces shall be located on the same lot as the dwelling
unit.
2. Garages The required parking spaces may include spaces within garages and/or
carports.
C. Prohibited: Parking of large commercial motor vehicles such as semi -truck cabs, semi -
truck trailers, semi -truck trac=uses
or any of the same combined and having an overall length
of more than twelve (12) feet, having an overall length of more than twelve (12)
feet, and the like, shall not be permitted. This prohibition shall not apply to the temporary

parking of large commercial motor vehicles actively in use by any contractors engaged in
construction or rehabilitation projects at a residential location.
5.53 PK-04: Multiple -family Residential Parking Standards
This Parking Standards section applies to the following zoning districts:
Multiple -Family Residential (Ml) District; and
Intense Multiple -Family Residential- (M2) District.
The following standards apply:
A. Exceptions: Assisted Living Facility and Nursing Homes shall be regulated by Table PKA.

1. Tenants: A minimum of two (2) parking spaces shall be required per dwelling unit.
2. Visitors: One (1) parking space for every four (4) dwelling units shall be required- for
visitors.
C. Location:
1. Tenants: Tenant parking spaces shall be located on the same site as the dwelling unit.
Tenant parking spaces may include spaces within garages and/or carports.
2. Visitors: Visitor parking spaces shall be located in a common parking area or as
angled parking along internal private streets, but shall be proportionately assigned to an
area within 200 feet of each multiple -family structure.
D. rohibited: Parking of large commercial motor vehicles such as semi -truck cabs, semi -
truck trailers, semi -truck tractors, or any of the same combined and having an overall length
of more than twelve (12) feet, and buses having an overall length of more than twelve (12)
feet, and the like, shall not be permitted. This prohibition shall not apply to the temporary
parking of large commercial motor vehicles actively in use by any contractors engaged in
construction or rehabilitation projects at a residential location.
5.64 PK-45: Manufactured Home Residential Parking Standards
This Parking Standards section applies to the following zoning districts*.
Manufactured Home Park (MP) District.
The following standards apply:

1. Dwelling Site= A minimum of two (2) parking spaces shall be required per dwelling site.
2. Visitors: One (1) parking space per every three (3) dwelling sites shall be required for
visitors.
B. Location:
1. .Dwelling Site: The required dwelling site parking spaces shall be located on the
dwelling site. The required dwelling site parking spaces may include spaces within
garages and/or carports.
2. Visitors: Visitor .parking spaces shall be located in a common parking area or as on -
street parking along internal private. streets, but shall be proportionately dispersed
throughout the development.
C. Prohibited: Parking of large commercial motor vehicles such as semi -truck cabs, semi -
truck trailers, semi -truck tractors, or any of the same combined and having an overall length
of more than twelve (12) feet, and buses having an overall length of more than twelve (12)
feet, and the like, shall not be permitted. This prohibition shall not apply to the temporary
parking o large commercial motor vehicles actively in use by any contractors engaged in
nstru ion or rehabilitation projects at a residential location.

NOW, THEREFORE, be it further ordained by the Common Council of the City of Richmond, Indiana,
that this Ordinance shall be in full force and effect from and after its passage and adoption by the
Common Council of the City of Richmond, Indiana.
