The Board must approve specific findings relative to the .~.y.~estalong with`ar~r. „~ ~aUdenial~ The Zoning~Ordinance e.4tablishes the criteria fora variance as follows:. 1. That satisfactory proof has been presented to the Board of Adjustment showing that the present or proposed situation of a requested building, structure, or use is reasonably necessary for the convenience or welfare of the public. 2. That the variance which is requested would not authorize any use other than uses enumerated as a use by right of the district. 3. That an unnecessary hardship to the owner would be shown to occur if the provisions of the Zoning Ordinance were literally followed. 4. That the circumstances found to constitute a hardship either were not created by the owner, or were in existence at the time of passage of the Zoning Ordinance, and cannot be reasonably corrected. 5. That the variance would not injure the value, use, or prevent the proper access of lighted air to the adjacent properties. 6. The owners hope to resubdivide _ the r.~„r.erty to convert the apartments to condominium units and to provide the same for the commercial r: „~, erty. ~_ . The Planning Commission initiated hearings on the preliminary plat, however, continugii the hearing as a variance from the minimum parking regt.:.:....ents is needed prior to. • consideration of the plat. The apartment building was constructed in compliance with the parking requirements at the time (which were lower than today). The saloon was existing at the time of the apartment construction. Since that time, the minimum parking requi.~,...,ents have increased and the ~.~~rertY lost parking spaces due to road improvemerrts. Thy applicant is requesting a parking variance, which must be approved prior to any subdivision approval. At this time, we have not resolved subdivision issues as the parkiflg variance is critical to any approval. The current code requirements would resu~t in,~the,need for 24 on site parking spaces for the residential units (2 per unit) and approximately 20 for the commercial (an estimate, depends on actual square footage). The subdivision code species that zoning and other code requirements must be complied with in order for subdivision approval to be granted, thus the variance request. As you know the procedure for a variance is that the Town Board reviews the request first and provides the Zoning Board of Adjustment with a recommendation. A hearing has been scheduled with the Zoning Board on June 26~'. Attached for your reference is a copy of the site plan, my initial report to the Planning Commission, a letter from Mr. Kinney, and a proposed parking arrangement with Byers Vets. Additionally, the' plat should specifically vacate the old iruternal lot lines. These are rather minor technical issues, the plat as r,. ~;..,~ented does provide an accxuate picture of the site improvements. I am working on confirmation that the facility (especially the apartment building) was constructed in a fashion that would be conducive to condominiums, in terms of building code issues. This would involve things like fire walls, utility services, egress, etc. The facility was constructed prior to adoption of our current codes, and would not comply with the minimum parking requiL ;,~..ents ts. The Subdivision Code does specify that no application for subdivision shall be approved if not in compliancg~ ~, with, among other things, the subdivision design standards of the Subdivision Code J and the Fraser Zoting Ordinance (parking). Variances could be requested and approved for loth. these issues. The Zoning Board of Appeals would have to address the parking variance, and the Planning Commission, as specified in the Subdivision Code, could grant a variance from the open space provisions. If any part of the rent provided to be paid herein is not paid when due, or if any default is made in any of the agreements by the Tenant contained herein, it shall be lawful for the Landlord to declare the term ended and to enter onto the parking spaces ,either with or without legal process, and to the Tenant and any other ~,:,..~on occupying parking spaces, without a breach of the peace, and without being liable to prosecution or in damages therefore, and to repossess the parking spaces free and clear of any rights of the Tenant.
