THIS ADDENDUM, (Number 1 to Contract No. 70-2019) is made and entered into this

� g g Board of Public Works and Safety with its office at 50 North 5
Street, Richmond, Indiana, 47374 (hereinafter referred to as "City"), and Beals -Moore &
Associates, Inc.', 122 South 8th Street, Richmond, Indiana, 47374 (hereinafter referred to as
"Contractor").
WHEREAS, City and Contractor entered into Contract - • No. 70 2019 on June 6, 2019, which
Agreement retains Contractor to provide professional surveying services and plat
preparation services for the City's Department of astructure and Development;
and .
WHEREAS, The Parties wish to amend said Agreement to increase ' the total "not to exceed"
payment amount estimated to be paid to Contractor pursuant to said Agreement.
Now, THEREFORE, in consideration of the mutual promises and covenants herein contained
including the above stated recitals, City and Contractor hereby agree as follows:
1. The City and Contractor executed and entered into Contract No. 70-2019, on
June 6 2019, which Agreement is incorporated herein by reference. Pursuant to
Contract' No. 70-2019, Section XI(Miscellaneous),the Parties
may alter or
amend the Agreement in whole or in part at any time by filing with the
Agreement a written instrument setting forth such changes signed by both Parties.
The Parties agree that due to additional work requested and expected to be
requested from Contractor, the estimated total amount to be paid to Contractor
shall be. increased, although the hourly quotes provided in the original Agreement
shall remain intact and unchanged. Said additional as -needed services provided
by Contractor shall be performed in a mariner consistent with Contract No. 70-
2019 for the term of the Agreement, which is hereby incorporated by reference
and made a part hereof. Actual payment shall depend on services rendered in
accordance with the Agreement and its stated hourly rates, and the new amount to
be paid to Contractor for services rendered under Contract No. 70-2019 and this
Addendum is estimated not to exceed Five Thousand Three Hundred Dollars
and Zero Cents ($5,300.00) for the term of the Agreement.
2. City and Contractor expressly agree that all other terms conditions ,and
covenants contained in ' Contract No. 70p2019, shall be applicable to this
Addendum, unless such term, condition or covenant conflicts with this Addendum
Number 1, in which case this Addendum Number.1 shall be controlling.

3. Both Parties hereby agree that with the exception of the increase to the total " „ P not

XI (Miscellaneous) of said Agreement, Contract No. 70-2019 shall remain intact
and unchanged and in full force and effect.
4. Both Parties agree that any person executing this Contract in a representative

capacity hereby warrants that he or she has been dulyauthorized'by his y or her
principal to execute this Addendum.
