Public Hearing/Regarding: a. Preliminary Plat East Mountain Filing 10 A replat of Lots 72-75 EMF1 Rendezvous PDD Amended Final Planned Development Plan East Mountain Filing 10 A portion of Filing No. 1 Rendezvous PDD Commissioner Sumrall moved, and Commissioner Brewer seconded the motion to reopen the public hearing on Preliminary Plat East Mountain Filing 10 A replat of Lots 72-75 EMF1 Rendezvous PDD and Amended Final Planned Development Plan East Mountain Filing 10 A portion of Filing No. 1 Rendezvous PDD. Motion carried: 5-0. This property is zoned Planned Development District and we are processing a Final Plan and a Major Subdivision Preliminary Plat. The Final Plan application is being processed in accordance with Section 16-5-410 of the Fraser Municipal Code. The Rendezvous development is also subject to the requirements contained in the 2003 Rendezvous Annexation Agreement and Planned Development District Plan (PDD), Reception # 2003-016735. This subdivision application is being processed as a Major Subdivision in accordance with Section 17-5-10 of the Fraser Municipal Code. The purpose of a major subdivision plat is to divide one (1) or more lots or parcels of land into a total of five (5) or more lots or five (5) or more dwelling units. This proposal relates to a portion of Filing No.1 as shown on the Rendezvous PDD Plan. The entitlements in the original PDD for this planning area (approximately 129.5 acres) allow for 110 detached residential units with an average density of .8 units per acre. The Fraser Municipal Code and the Annexation Agreement allow for a density transfer between planning areas. If a density transfer exceeds 30%, then the PDD must be formally amended. If the density transfer is 30% or less, then an amendment to the Final Plan is required. As referenced above, the PDD allows for 110 detached residential units. If a 30% density transfer is permitted, the maximum number of units allowed in this planning area is a total of 143 (unless the applicant formally amends the PDD) on 129.5 acres which equates to 1 unit per acre. The density of the proposed EMF10 equates to 2.91 units per acre. In 2008, Rendezvous processed East Mountain Filing 5 (EMF5), which was a replat of lots 99-110, inclusive, of East Mountain Filing No. 1. This subdivision replatted 12 custom home lots into 27 smaller lots. A density transfer was utilized during this replatting process. [For the explanation below, lots = detached residential units] So, 110 lots - 12 lots + 27 lots = 125 lots currently in this planning area. Again, with a 30% density transfer, 143 units are allowed. The applicant is proposing to replat 4 custom home lots into 21 lots. 12 residential units are being transferred from Planning Area 9E and 5 residential units are being transferred from Planning Area 11E. See Final Plan sheet 4 of 9, density transfer chart. 125 lots – 4 (custom home lots being replatted) + 21 lots = 142 lots The proposed setbacks are similar to the EMF5 (lots 99-125) plat except that the front setback has been reduced to 10’ instead of 15’. See Final Plan sheet 1 of 9, general note #2. Final Plan sheet 6 of 9 identifies the size of the lots in EMF5 and the proposed size of the lots in EMF10. EMF5, lot 125 is the smallest lot at .17 AC EMF5, lot 112 is the largest lot at .49 AC EMF10, lot 135 is the smallest lot at .11 AC EMF10, lot 142 is the largest lot at .18 AC The density for EMF5 is 2.08 units/acre. The applicant was originally proposing to eliminate 4 custom home lots and plat 21 single-family attached lots, creating an additional 17 lots. See Vogel & Associates project narrative. The primary access will be provided via Rendezvous Road to Pioneer Trail and the internal streets shall be private and maintained by the Association. The applicant has requested a variance to Section 17-7-520 of the subdivision regulations which specifies the following: “Subdivision road systems shall be designed with two (2) or more publically dedicated access easements and constructed roads for separate, multiple ingress and egress.” See TKE memo entitled variance request. The Planning Commission had continued the public hearing from May 25, 2016 to allow the applicant and staff to review the overall site plan and perhaps negotiate a lower density. The applicant is now proposing to create 18 lots instead of 21. Public Comment was taken from: Keith Neil Todd Holdsworth Jack DiCola Jack Emerson Schumacher couple Pending any additional comments from the public hearing and if the Planning Commission decides to recommend approval of the Preliminary Plat and Final Plan for EMF10, staff would recommend the following conditions: Change the title of the Final Plan to the following: “Amended Final Planned Development Plan East Mountain Filing 10, a portion of Filing No. 1.” Final Plan general note #7 references open space calculations and sheet 5 and 6 of 9. Clarify the site data chart on sheet 5 and separate open space acreage and “% of total area” from the road acreage and “% of total area”. Identify the 20% open space referenced in general note #7. Add a plat note as follows: “No lots shall have direct access off Pioneer Trail or Bridger Trace.” Provide any and all off-site easements. Reception numbers of any such easements shall be added to the plat at time of recordation. Clarify open space tracts and percentage on plat. Plat note #5 suggests that Tracts A & C will be used for open space and parking. Parking is not an allowed use in open space. Provide street names on plat. Setback language on plat and plan needs to be consistent. The plan suggests that the front setback varies due to a front-loaded vs. side-loaded garage. The “typical lot setback” (plat sheet 3, 4, 5 and 6) on the plat indicates 10’ front setback. Clarify. Add Mountain Parks Electric language to plat notes per Jean Johnston, email dated March 17, 2016. Address all of Jim Swanson’s comments in the JRS memo dated March 12, 2016 and updated March 15, 2016 and revise documentation accordingly. Applicant to confirm that there will be adequate water pressure and volume at each lot for this subdivision. It may be necessary to run the hydraulic water model for confirmation. In order to confirm adequate pressure and flow capacity for each lot, include a table on the plat identifying required water service line sizes for each lot. Delete trail connection to the northeast corner on sheet 2 of 6 in accordance with the Final Plan. Clarify the Density Transfer Chart on the Final Plan sheet 4 of 9. Applicant agrees that all exterior lighting shall be dark sky compliant. Add note to the Final Plat and Final Plan to require such compliance. Applicant shall revise the Final Plat and Final Plan to reflect the reduced density consistent with the revised site plan and narrative submitted on June 2, 2016. Applicant to submit variance requests from the Design Criteria and Constructions Standards, including Section 14-3-60 Vertical alignment and Section 14-3-40, Horizontal alignment. Zoning Code Amendments specific to parking Commissioner Sumrall moved, and Commissioner Quinn seconded the motion to reopen the public hearing on Zoning Code Amendments specific to parking. Motion carried: 5-0. The Planning Commission had “review the parking regulations” on their 2016 work plan. We have taken a closer look at our regulations and many other communities both within state and out of state. We have studied parking management and strategies and watched webinars on the same. We have overhauled the Fraser parking regulations to enable and encourage innovation in an attempt to improve the quality and character of the community and build a healthier economy. Thank you to the PC for all their hard work and effort! Staff is recommending approval. Commissioner Quinn moved and Commissioner Sumrall seconded the motion to approve Planning Commission Resolution 2016-06- 02 A Resolution Recommending Approval of the Adoption of the Amendments to the Zoning Code Specifically Relating to Parking Regulations as Contained in the Fraser Municipal Code, Chapter 16.
