Roll Call: 2. Approval of Agenda: Minutes of June 8, 2016 Commissioner Vandernail moved, and Commissioner Quinn seconded the motion to approve the Agenda. Motion carried: 4-0. 3. Open Forum: 4. Public Hearing/Regarding: a. Major Subdivision Final Plat East Mountain Filing 10 A replat of Lots 72-75 EMF1 Rendezvous PDD Commissioner Brewer moved, and Commissioner Quinn seconded the motion to open the public hearing on Major Subdivision Final Plat East Mountain Filing 10 - A replat of Lots 72-75 EMF1 Rendezvous PDD. Motion carried: 4-0. Proof of publication was submitted. This property is zoned Planned Development District and we are processing a Major Subdivision Final Plat. This subdivision application is being processed as a Major Subdivision in accordance with Section 17-5-10 of the Fraser Municipal Code. The purpose of a major subdivision plat is to divide one (1) or more lots or parcels of land into a total of five (5) or more lots or five (5) or more dwelling units. This proposal relates to a portion of Filing No.1 as shown on the Rendezvous PDD Plan. The entitlements in the original PDD for this planning area (approximately 129.5 acres) allow for 110 detached residential units with an average density of .8 units per acre. The Fraser Municipal Code and the Annexation Agreement allow for a density transfer between planning areas. If a density transfer exceeds 30%, then the PDD must be formally amended. If the density transfer is 30% or less, then an amendment to the Final Plan is required. As referenced above, the PDD allows for 110 detached residential units. If a 30% density transfer is permitted, the maximum number of units allowed in this planning area is a total of 143 (unless the applicant formally amends the PDD) on 129.5 acres which equates to 1 unit per acre. In 2008, Rendezvous processed East Mountain Filing 5 (EMF5), which was a replat of lots 99-110, inclusive, of East Mountain Filing No. 1. This subdivision replatted 12 custom home lots into 27 smaller lots. A density transfer was utilized during this replatting process. [For the explanation below, lots = detached residential units] So, 110 lots - 12 lots + 27 lots = 125 lots currently in this planning area. Again, with a 30% density transfer, 143 units are allowed. The applicant is now proposing to replat 4 custom home lots into 18 lots. 12 residential units are being transferred from Planning Area 9E and 5 residential units are being transferred from Planning Area 11E. 125 lots – 4 (custom home lots being replatted) + 18 lots = 139 lots The proposed setbacks are similar to the EMF5 (lots 99-125) plat except that the front setback has been reduced to 10’ instead of 15’. The applicant is proposing to eliminate 4 custom home lots and plat 18 single-family detached lots, creating an additional 14 lots. The primary access will be provided via Rendezvous Road and the internal streets shall be private and maintained by the Association. The applicant has requested a variance to Section 17-7-520 of the subdivision regulations which specifies the following: “Subdivision road systems shall be designed with two (2) or more publically dedicated access easements and constructed roads for separate, multiple ingress and egress.” See TKE memo entitled variance request. Pending any public comments at the hearing, staff is recommending approval of the final plat with conditions. Commissioner Vandernail moved, and Commissioner Brewer seconded the motion to Approve Resolution 2016-07-01 a Resolution recommending approval of East Mountain Filing 10 (EMF10) final plat, a portion of filing no. 1, Rendezvous planned development district, located in section 28, township 1 south, range 75 west of the 6th p.m., town of Fraser, Grand County, Colorado. Motion carried: 4-0. 5. Adjourn Commissioner Vandernail moved, and Commissioner Quinn seconded the motion to adjourn. Motion carried: 4-0.
