HomeMy Public PortalAboutPCM 2016-11-09FRASER PLANNING COMMISSION MINUTES DATE: Wednesday, November 9, 2016 MEETING: Planning Commission Special Meeting PLACE: Fraser Town Hall Board Room PRESENT Commission: Commissioners: Chair Jean Wolter, Steve Sumrall, Cody Clayton Taylor, Parnell Quinn, Debbie Young, Mayor Vandernail and Sam Brewer Staff: Town Planner, Catherine Trotter Others: Matt Priebe, Betsy & Gary deVries. Chairperson called the meeting to order at 6:30 p.m. 1. Roll Call: 2. Approval of Minutes: Minutes of September 28, 2016 Mayor Vandernail moved, and Commissioner Brewer seconded the motion to approve the Minutes. Motion carried: 7-0. 3. Open Forum: 4. Public Hearing/Regarding: a. Amended Final Plat for Lots 3 & 4 Block 3 Workshire Acres and Amended As-Built Plat for Byers Peek Townhomes of Fraser Commissioner Quinn moved, and Mayor Vandernail seconded the motion to open the public hearing. Motion carried: 7-0. Proof of publication and notification to adjacent property owners were entered into record. For background information, please review Amended Final Plat Reception # 2000006937. This is a plat of Lots 1, 2 and 3 Block 3 Workshire Acres. Subsequently, Lot 3 was re-subdivided in 2003 into a four unit townhome structure. See As-Built Plat Reception # 2003004153. The current owners of lot 4, Matthew & Brianna Priebe, are working with the Byers Peek at Fraser Building 3 Homeowners Association to purchase a strip of property 19’ width and 103.34’ long in order to add more land to existing Lot 4. The proposed plat would vacate the existing north/south lot line of Lot 4 and move the new lot line to the east by 19’. The owners of Lot 4 were interested in purchasing the other 15.82’; however, that would leave Lot 3 without the required 55% open space per the subdivision regulations. This application is being processed as a minor subdivision in accordance with Section 17-4-10 of the Fraser Municipal Code. The purpose and scope of a minor subdivision is that the resulting subdivision will create a total of not more than four (4) lots or four (4) dwelling units and no new streets need to be constructed and municipal utilities exist immediately adjacent to the parcel and do not need to be extended to serve the subdivision. Staff is recommending approval with the following comments: Change the name of the plat to the following: Amended Final Plat for Lots 3 & 4 Block 3 Workshire Acres, Reception # 200006937 AND Amended As-Built Plat for Byers Peek Townhomes of Fraser Building 3,Reception #2003001453 The dedication needs to reference Lots 3 and 4 instead of Lots 2 and 3. Delete Planning Commission Certification. Change ownership of Lot 4 to include Brianna Priebe. Delete ownership information on Lots 1 and 2. Provide a warranty deed and legal description for the part of Lot 3 to be transferred to Lot 4 and record in conjunction with the plat. Mayor Vandernail moved, and Commissioner Taylor seconded the motion to close the public hearing. Motion carried: 7-0. Commissioner Quinn moved, and Commission Brewer seconded the motion to approve Planning Commission Resolution 2016-11-01 recommending approval of the Amended Final Plat for Lots 3 & 4 Block 3 Workshire Acres, Reception # 200006937 AND Amended As-Built Plat for Byers Peek Townhomes of Fraser Building 3,Reception #2003001453 with conditions. b. Annual Update to Three Mile Plan. Commissioner Sumrall moved, and Commissioner Taylor seconded the motion to approve Planning Commission 2016-11-02 recommending approval of Fraser’s Three Mile Plan with no changes. Discussion on possible code changes to foster & incentivize attainable housing. 6. Adjourn Mayor Vandernail moved, and Commissioner Taylor seconded the motion to adjourn. Motion carried: 7-0.
