HomeMy Public PortalAboutResolution 96-1822 PC" " RESOLUTION NO. 96- 1822PC A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TEMPLE CITY APPROVING CONDITIONAL USE PERMIT 96 -1282, A REQUEST TO ALLOW A DIGITAL WIRELESS TRANSMITTING AND RECEIVING STATION CONSISTING OF NINE SLENDER (POPSICLE STICK) ANTENNAS MOUNTED ON THE ROOF OF AN EXISTING SINGLE STORY BUILDING FOR THE PROPERTY LOCATED AT 6264 ROSEMEAD BOULEVARD IN THE GENERAL COMMERCIAL (C -2) ZONE. (COX COMMUNICATIONS) The Planning Commission of the City of Temple City does hereby resolve: SECTION 1. Based upon a public hearing for the above Conditional Use Permit, the Planning Commission finds: 1. That the site for the proposed use is adequate in size, shape, topography and circumstances in that the site is a corner lot fronting onto Rosemead Boulevard and Longden Avenue; although the proposed antennas would be visible, the subject building faces Rosemead Boulevard, a heavily traveled state highway; and 2. That the site has sufficient access to streets and highways, adequate in width and pavement type to carry the quantity and quality of traffic generated by the proposed use in that the site contains vehicular access from Rosemead Boulevard and Longden Avenue; additionally, the telecommunications facility is unmanned and will not generate an onerous increase in traffic; and 3. That the proposed use will not have an adverse effect upon the use, enjoyment or valuation of adjacent property or upon the public welfare in that the proposed telecommunications antennas will be located on top of an existing single story building; unlike other types of antenna systems, the subject proposal will consist of rather slender antennas. SECTION 2. This project should not result in significant effects upon the environment and a Negative Declaration has been prepared in accordance with the State CEQA Guidelines. The initial statement as prepared indicates there is no potential for adverse impact to the environment as it relates to all wild animals, birds, plants, fish, amphibians, and related ecological communities, including the habitat upon which the wildlife depends for its continued viability. For a detailed Environmental Analysis of an application similar to the proposed project, refer to the previous Airtouch Cellular application (CUP 93 -1187) to locate a cellular antenna at Temple City High School. An Expanded Negative Declaration studying the potential health effects from non - ionizing electromagnetic radiation (EMR) was prepared by EIP Associates for the project. The Expanded Negative Declaration contains an Resolution No. 96- 1822PC Page 2 Conditional Use Permit 96 -1282 Environmental Checklist as well as the Negative Declaration and concluded that the proposed cellular facility would not have a significant effect on the environment. SECTION 3. Accordingly, Conditional Use Permit 96 -1282 is approved based upon and subject to substantial compliance with the simulated photos presented at the Planning Commission meeting. Specifically, the proposed nine (9) slender antennas shall not be screened from view. SECTION 4. The Secretary shall certify to the adoption of this Resolution. I hereby certify that the foregoing Resolution was adopted by the Planning Commission of the City of Temple City at a regular meeting held on the 27th of August, 1996, by the following vote: AYES: Commissioner -- Brook, Seibert, Larson and Griffiths NOES: Commissioner -- ABSENT: Commissioner -- Muto Secretary • •
