Reiman, Thursday, July 17, 2014, 6:00 P.M., Council Chambers, Memorial Municipal Building, 61 Cooke Avenue, Carteret, New Jersey. Upon individual roll call vote the following were noted present Councilmember Vincent Bellino Jorge Diaz " Dennis DiMascio " Randy Krum " Joseph W. Sitarz Noted absent was Council President Susan Naples and Borough Attorney Robert J. Bergen, Esq. Also noted present was Municipal Clerk, Kathleen M. Barney and Michael Sica, Esq. The meeting was opened with a minute of silent prayer and the Pledge of Allegiance led by Mayor Daniel J. Reiman. The Clerk stated that on January 6, 2014, the 2014 Annual Notice was mailed to The Home News Tribune, The' Star Ledger and posted on the Bulletin Board. Notice was published in The Home News Tribune on January 8, 2014 and The Star Ledger on January 9, 2014. Roll Call Noted Absent Also Noted Present Silent Prayer/ Pledge of Allegiance Statement of Meeting Notice -1- July 17, 2014 Minutes for Approval Upon MMS &C by Councilmembers Sitarz and Bellino and unanimous affirmative vote of the five (5) Councilmembers present, the Minutes of July 10, 2014 were approved and transcribed and engrossed by the Clerk. Ordinance #14 -17 ORDINANCE #14 -17 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held August 7, 2014 upon MMS &C by First Reading Councilmembers Krum and Bellino. Upon individual roll call vote Councilmembers Bellino, Diaz, DiMascio, Krum and Sitarz voted in the affirmative. Councilmember Naples was noted absent. "AN ORDINANCE OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, STATE OF NEW JERSEY, APPROVING AND AUTHORIZING THE ENTERING INTO, EXECUTION AND DELIVERY OF A LEASE AND AGREEMENT WITH THE MIDDLESEX COUNTY IMPROVEMENT AUTHORITY RELATING TO THE ISSUANCE OF COUNTY - GUARANTEED CAPITAL EQUIPMENT AND IMPROVEMENT REVENUE BONDS, SERIES 2014 OF THE MIDDLESEX COUNTY IMPROVEMENT AUTHORITY" Ordinance #14 -18 ORDINANCE 414 -18 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise same for Public Hearing to be held August 7, 2014 upon MMS &C by Councilmembers Krum and Bellino. Councilmember Naples was noted absent. -2- July 17, 2014 ORDINANCE #14 -18 "A LOAN ORDINANCE OF THE BOROUGH OF CARTERET, IN THE COUNTY OF MIDDLESEX, STATE OF NEW JERSEY APPROVING AND AUTHORIZING THE ENTERING INTO, EXECUTION AND DELIVERY OF A LOAN AND SECURITY AGREEMENT WITH THE MIDDLESEX COUNTY IMPROVEMENT AUTHORITY FOR THE UNDERTAKING OF VARIOUS 2014 CAPITAL IMPROVEMENTS AND VARIOUS EQUIPMENT WITH AN ESTIMATED COXT OF $225,000 THE COST OF SUCH IMPROVEMENTS AND EQUIPMENT TO BE FINANCED THROUGH THE ISSUANCE OF COUNTY - GUARANTEED CAPITAL EQUIPMENT AND IMPROVEMENT REVENUE BONDS,SERIES 2014 OF THE MIDDLESEX COUNTY IMPROVEMENT AUTHORITY" Ordinance #14 -19 ORDINANCE #14 -19 was introduced and adopted on First Reading and the Clerk authorized and directed to advertise for Public hearing to be held on September 18, 2014 upon MMS &C by Sitarz and Krum. Upon individual roll call vote Councilmembers Bellino, Diaz, DiMascio, Krum and Sitarz voted ' in the affirmative. First Reading Councilmember Naples was noted absent. "AN ORDINANCE AMEDING CODE, CHAPTER 160, SECTION 107, DRIVEWAYS AND 119.1, CERTIFICATES OF OCCUPANCY" Mayor Reiman said that this ordinance would allow residents to RE: Driveways widen their driveways in an R50 Zone, from 14 feet to 17 feet. This would go up to 22 feet to 23 feet. Most driveways in the Borough are technically illegal so this would help the R50's single family homes. -3- July 17, 2014 Councilmember Diaz asked how that would affect the CO's. Mayor Reiman replied.that this is a different part of the chapter. Re: S�dEtelks The occupancy Chapter portion has to do with the sidewalk. We had an Ordinance that we did in 2004, that when a house is sold the inspector checks the sidewalks. If it's cracked or not there, they have to put it in. Somehow that section was deleted. In 2010 when we did revisions of Chapter 160 the entire section was denoted as being deleted from the Borough Code. Currently, you know we are enforcing the Sidewalk Ordinance, there is no sidewalk ordinance. We're doing two amendments. Councilmember DiMascio asked what size are legal driveways. Mayor Reiman replied that under the current code it depends if there is an R50 or R25 Zone and it depends if you have a garage. Technically, if you don't have a garage, you're not allowed to have a driveway, which is ridiculous, because everyone has them. If you read the code, the strict interpretation .... because we had an issue iscussion residents who as we're upgrading the streets, they want to put in a new sidewalks and driveways. They're coming in and saying they want to do their driveway, it's currently22 feet wide so they can fit two cars. Downstairs is only giving them a permit to do one because it is not allowed. We're going to make so you can have a larger driveway. Thirty or fifty years ago who cared, when there was one car per house. Now, he's rather them have more driveway space so that they can get the cars off the roadways, Councilmember DiMascio asked if it was legal to park your car on the lawn. -4- July 17, 2014 Mayor Reiman replied no. Technically it is not legal. It would fall Discussion under construction or property maintenance. The police aren't (Continued) going to get involved. It is an issue with the property and how you use it. If it was an emergency or something like a storm event and you wanted to get your car off the road that is different. But to make a parking lot out of the lawn, they can't do that. Councilmember Diaz asked about Washington Avenue. Mayor Reiman replied that they put in a driveway on Washington Avenue. So these get turned over to the Planning Board and then they will come back to us for final review. ORDINANCE #14 -20 was introduced and adopted on First Reading Ordinance #14 -20 and the Clerk authorized and directed to advertise same for Public Hearing to be held_November 13, 2014 Upon MMS &C by First Reading Councilmembers Diaz and Bellino. Upon individual roll call vote Councilmembers Bellino, Diaz, DiMascio, Krum and Sitarz voted in the affirmative. Councilmember Naples was noted absent. "Amending Ordinance 471 -9" Mayor Reiman explained that we have several contracts that we Crossing Guard are still negotiating. We still have to finalize them at the next Salary Ordinance meeting and we will publicize the Crossing Guard Salary Ordinance. Resolutions #14 -150 through #14 -152 were introduced by the Mayor and referred to the Council for action. COMMITTEES: Committees BUILDINGS & GROUNDS: In the absence of Committee Buildings & Grounds Chairperson Naples Mayor Reiman reported progress in this department. FINANCE & ADMINISTRATION: Committee Chairperson Diaz Finance & Administration reported progress. In the Tax Collection Office, the bills should be out by tomorrow. We are also preparing to advertise for the Tax Sale and we are looking for the option for an on line tax sale. We'll have more information at that the next meeting. Other than that, continued Progress. -7- July 17, 2014 Fire & Domestic Preparedness Parks, Recreation & Public Property Police Public Works FIRE & DOMESTIC PREPAREDNESS: Committee Chairperson Krum reported Progress in his department. PARKS, RECREATION & PUBLIC PROPERTY: Committee Chairperson Bellino reported progress in his department. POLICE: Committee Chairperson Sitarz reported progress in his department. PUBLIC WORKS: Committee Chairperson DiMascio reported progress in his department. Board of Education BOARD OF EDUCATION LIAISON: Committee Chairperson Naples was noted absent. Mayor Reiman reported Progress in this department. Mayor Reiman issued the following Proclamations: National Night Out "BOROUGH OF CARTERET MIDDLESEX COUNTY, NEW JERSEY PROCLAMATION NATIONAL NIGHT OUT 2014 WHEREAS, the National Association of Town Watch (NATW) is sponsoring a unique, nationwide crime, drug and violence prevention program on August 5 2014 called "NATIONAL NIGHT OUT "; and WHEREAS, the "31 ANNUAL NATIONAL NIGHT OUT" provides a unique opportunity for the Borough of Carteret to join forces with thousands of other communities across the country in promoting cooperative, police- community crime prevention efforts; and July 17, 2014 WHEREAS, the Crime Prevention Unit plays a vital role in assisting the Carteret Police Department through joint crime, drug and violence prevention efforts in the Borough of Carteret; and WHEREAS, it is essential that all citizens of the Borough of Carteret be aware of the importance of crime prevention programs and impact that their participation can have a reducing crime, drugs and violence in the Borough of Carteret; and WHEREAS, police- community partnership, neighborhood safety, awareness and co- operation are important themes of the "NATIONAL NIGHT OUT" program; NOW, THEREFORE, WE, The Mayor and Council do hereby call upon the citizens of the Borough of Carteret to join the Carteret Police Department's Crime Prevention Unit and the NATIONAL ASSOCIATION OF TOWN WATCH in supporting the "31' Annual National out" on August 5 2014 as "NATIONAL NIGHT OUT in the Borough of Carteret. FURTHER, LET IT BE RESOLVED THAT, WE, the Mayor and Council do hereby proclaim Tuesday, August 5 th , 2014 as "NATIONAL NIGHT OUT" in the Borough of Carteret. PROCLAMATION Drive Sober or DRIVE SOBER OR GET PULLED OVER Get Pulled Over WHEREAS, alcohol impaired fatalities accounted for 19% of New Jersey's traffic fatalities in 2012; and WHEREAS, impaired driving remains a significant issue throughout New Jersey; and -9- July 17, 2014 WHEREAS, the division of Highway Traffic Safety has set a goal to reduce the rate of alcohol related fatalities by five percent from 2010 -2012 base year average; and Proclaration (Continued) WHEREAS, the state of New Jersey will participate in a statewide Drive Sober or Get Pulled Over Statewide Labor Day Crackdown between August 15 and September 1, 2014 in an effort to reduce alcohol related fatalities through a combination of education and enforcement; and WHEREAS, a further decrease of impaired drivers in New Jersey will save lives on our roadways; NOW, THEREFORE, I, DANIEL J. REIMAN, Mayor of the Borough of Carteret, in conjunction with the Borough Council, in the County of Middlesex, State of New Jersey do hereby call for support of the statewide Drive Sober or Get Pulled Over Labor Day Crackdown.
