HomeMy Public PortalAbout001-2005 - Board of PUblic Works & Safety re Salisbury roadBOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA RESOLUTION NO. 1 -2005 WHEREAS, The Board of Public Works and Safety ( "Board ") is the disposing agent for real property owned and to be transferred or acquired by the City of Richmond, Indiana ( "City ") pursuant to the provisions of Indiana Code (IC) 36 -1 -11, et. Seq. (the "Act "); and WHEREAS, Wayne County, Indiana ( "County ") owns certain real estate that abuts the current right -of -way of a portion of Salisbury Road that is located within the incorporated area of the City; and WHEREAS, City proposes to widen and otherwise improve a portion of said Salisbury Road in accordance with plans and specifications therefor prepared by Burgess and Niple, Inc., of Indianapolis, Indiana and being designated as Project No. 40878 (the "Project "), including part of the road that abuts the property owned by County; and WHEREAS, City needs to acquire certain land owned by County to complete the Project; said land being more particularly described on the attached "Exhibit A" made a part hereof (the "Subject Real Estate "); and WHEREAS, City and County mutually recognize the public good and benefit that would result from the completion of the Project and each is willing to receive or convey the Subject Real Estate in accordance with the terms of this Resolution. NOW, THEREFORE, BE IT RESOLVED that this Board authorizes the acceptance by City of the conveyance of the Subject Real Estate, as more particularly described on the attached "Exhibit A" for use by City in completing the Project. BE IT FURTHER RESOLVED, that, pursuant to Section 8 of the Act (IC 36 -1- 11-8), no consideration will be charged by County or paid by City for such conveyance; PROVIDED HOWEVER, that the instrument of conveyance by which City shall acquire title to the Subject Real Estate shall contain a reversionary clause by which title to the Subject Real Estate shall revert to County should the Project not be completed within three (3) years from the date of the conveyance. BE IT FURTHER RESOLVED, that the City's Department of Law be, and is hereby directed, to cause to be prepared all documents necessary or convenient to affect the transfer of title to the Subject Real Estate as herein authorized and contemplated.
