HomeMy Public PortalAbout005-2006 - BOW resolution for ERC'sBOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA RESOLUTION NO. 5 -2006 A RESOLUTION AUTHORIZING THE SIGNING OF ENVIRONMENTAL RESTRICTIVE COVENANTS WHEREAS, The City of Richmond, Indiana, has had environmental remediation work done on the real estate located at South lst Street, Richmond, Indiana, commonly known as the Whitewater Valley Gorge Park (formerly Starr - Gennett facility); and WHEREAS, The City of Richmond, Indiana, has worked with the Indiana Department of Environmental Management (IDEM) concerning contaminates of concern at the Whitewater Valley Gorge Park (formerly Starr - Gennett facility) site, IDEM Brownfields site number *4000018; and WHEREAS, IDEM issued two "No Further Action" letters pursuant to the Brownfields Program's recommendation at the request of the City of Richmond, and in conjunction with a Petroleum Remediation Grant Incentive Agreement; and WHEREAS, The Environmental Restrictive Covenants have been prepared by Meredith Gramelspacher, an attorney for the Indiana Department of Environmental Management, and said Environmental Restrictive Covenants are attached to this Resolution and incorporated herein as Exhibits A and B, which Environmental Restrictive Covenants include the legal descriptions to the property commonly known as the Whitewater Valley Gorge Park (formerly Starr - Gennett facility) located at South 1 st Street, Richmond, Indiana. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS AND SAFETY OF RICHMOND, INDIANA, that said Board approves the Environmental Restrictive Covenants submitted to the Board by the Director of Metropolitan Development, Anthony Foster II, concerning the Whitewater Valley Gorge Park (formerly Starr - Gennett facility) located at South 1 st Street, Richmond, Indiana, copies of which are attached with this Resolution. NOW FURTHER BE IT RESOLVED that the Board of Public Works and Safety of Richmond, Indiana, that the Board President, John P. Kenny, be authorized to sign the Environmental Restrictive Covenants for and on behalf of the City of Richmond, Indiana, acting through its Board of Public Works and Safety of Richmond, Indiana. NOW FURTHER BE IT RESOLVED that upon signing of the Environmental Restrictive Covenants by John P. Kenny, that Anthony Foster II, Director of Metropolitan Development for the City of Richmond, Indiana or his designee, shall immediately have said Environmental Restrictive Covenants recorded in the Wayne County Recorder's Office, and to have a copy properly submitted to IDEM.
